"Plan / Profile of Lowell Road Relocation for CSC Group in Mashpee, Massachusetts" <br /> revised April 5, 2001 by Christopher Costa & Assoc., P.O. Box 128 / 465 Main Street, <br /> East Falmouth, Mass. <br /> 2. That portion of Nathan Andrew Circle lying on, and east of, the proposed Lowell Road <br /> relocation (shown with dashed lines on the definitive subdivision plan) shall be constructed <br /> with a proper crushed stone base only, to be used as an emergency second access to the <br /> subdivision until such time as said relocation is constructed by the Town of Mashpee. Said <br /> emergency access shall be provided with a gate, of a type approved by the Mashpee Fre <br /> Department, sufficient to prevent through traffic, with any necessary keys provided to the <br /> Mashpee Fire and Police Departments. Upon construction of the relocation, any gate shall <br /> be removed and the pavement shall be completed to join with that of Lowell Road as per <br /> the approved subdivision plans. At that time, the portion east of relocated Lowell Road <br /> shall be reconfigured as necessary to serve as a driveway access to the parcel shown on <br /> the 2000 Mashpee Assessors' Maps as Map 52, Block 23. In anticipation of said relocation, <br /> a driveway access and maintenance easement shall be deeded to the owner of said lot over <br /> said crushed stone roadway, with a copy of said easement with recordation data submitted <br /> to the Planning Board prior to the release of the roadway covenant for the 15'h lot in the <br /> subdivision. <br /> 3. The applicant has agreed to, and shall, donate to the Town of Mashpee the portion of this <br /> property required for the relocation of the layout of Lowell Road upon request by the Town <br /> after the relocation is approved by Mashpee Town Meeting. <br /> 4. The applicant has chosen to deed the open space parcels A, B and C to the Town of <br /> Mashpee in the care and custody of the Mashpee Conservation Commission. Said deed <br /> shall be made subject to a permanent deed restriction so that the required open land shall <br /> be: <br /> (a) Restricted to agricultural, open space or park uses and, except for agricultural uses, <br /> shall be left in essentially its undisturbed natural state, except for pedestrian, equestrian <br /> or bicycle trails, minor clearing for water wells, pumphouses and related access, <br /> provided that such uses or activities may disturb no more than ten percent (10%) of <br /> such open land. <br /> (b) Open to such allowed uses by the general public. <br /> (c) Restricted so that no structure, road, parking area, tennis court or similar development <br /> shall be erected thereon, except for the required driveway access to Map 52, Block 23 or <br /> for pumphouses and similar minor public utility structures, and so that no such structure <br /> shall be more than fifteen (15) feet in height. <br /> A copy of the signed and recorded or recordable deed shall be provided to the Planning <br /> Board within six (6) months of the approval of this decision or prior to the issuance of a <br /> roadway covenant release for more than 14 lots in the subdivision, whichever is later. <br /> 5. Except where said decision conflicts with the terms of this special permit, the Project shall <br /> be constructed in conformance with the terms and conditions of the Development of <br /> -a- <br />
