rt <br /> Page <br /> variance; they just got a letter from Attorney Brady a month ago. The reason the <br /> lawyer is here, he said, is that they errant Mr. Bornstein to pay for things outside of <br /> contract and that they are using the open space issue as leverage. He claims <br /> they are intentionally trying to hold up the process. He agreed that a review <br /> should take place, but that it should not hold things up. There is a lengthy, heated <br /> discussion about this. <br /> Matt continued to assert that the Planning Board is very well aware of what its <br /> responsibilities are. ToM- Fudala brought up Phase 11 and completion of waste <br /> water treatment plan. Torn Guinn answered that the treatment plan was almost <br /> done and that only four more units are allowed-before the plant must be <br /> operational. Torn Fudala said that he would send.a memo to the building <br /> inspector not,to issue permits-for more than 6 o units unless,treatment plan was <br /> operational. <br /> Motion by Dennis to release covenant to lots 29 & 30, Industrial Drive. Seconded <br /> by Beverly, carried unanimously. <br /> Talanian Realty Co., Inc.;-Ag r val of Special Permit (continuedl <br /> Tom Fudala opened with Condition # 12. He said that farther changes were made <br /> regarding-square footage. <br /> Charlie suggested adding wording that would mean Shellback Way "and related <br /> access drive vays."Also, that Condition ##15 shou Id include a plan for "seasonally <br /> appropriate" landscaping. This opened a lengthy discussion about restrictions on <br /> the amount of vegetation to be stripped. It was suggested that wording be <br /> changed to reflect stripping "for-valid construction purposes only" that was <br /> consistent with phasing schedule on file with the Planning Board. <br /> Tone Fudala then began discussion on.the revised storm grater management <br /> plan. He suggested tentative approval or approval with conditions. <br /> Motion by Beverly to close the public hearing. Seconded by Beverly; carved <br /> unanimously. <br /> Motion by Dennis to approve the special permit with the changes that have <br /> become part of the record. Dennis to review and sign. Seconded by Martine; <br /> carried unanimously. <br /> Motion by Dennis to continue Park Avenue Fealty Trust/Harbor Homes to May <br /> 1W at :15 p.m. Seconded by Martine; carried unanimously. <br />
