Hp acknowledged the fact that the access cannot be blocked in any manner. �0 <br /> 4, <br /> Mr. Rowley also made reference to the condominiums within <br /> the deve 1 opment, noting the Plan of Record indicates individual <br /> lots* <br /> At this point the Chairman made reference to the Special <br /> Permit Decision: Modification is issued pursuant to Sections 9 .3 <br /> and 9 .4 Mashpee Zoning Bylaws, as they existed on November 6, <br /> 1985 . <br /> "Facts and Findings: At a public hearing applicant <br /> presented the Planning Board proposed modification. . .access ay <br /> connection from Herring Gull Road to the Willowbend Phase I <br /> area. . .proposed access drive and utilityconnections are shown on <br /> , <br /> a Plan of Land entitled. . .The road will be twenty-two (22) feet x ._ <br /> in width. . . traverse of forty (4 0) foot buffer zone around <br /> Willowbend property. . .willowbend will build the road to <br /> subdivision specs, although subdivision approval is not being <br /> requested as the new access will not serve as frontage. <br /> r <br /> 1 i <br /> The Board finds that the modifications to the original <br /> submittal, changes to the area did not differ significantly from <br /> i <br /> the layout of this area. The addition of a second access point <br /> will increase the ability of emergency vehicles to access the <br /> back of Phase I, as well as Shoestring Bay lots. . .looping the . <br /> water system will increase pressure. . .applicant has met with they ,; <br /> District. In response to requests by the neighborhood, applicant <br /> is proposing to connect thirty-six (36) lots within Shoestring r <br /> Bay subdivision to sewage treatment. Applicant presented an <br /> analysis by Team Engineering showing the capacity of the plant is <br /> one hundred thirteen thousand (113, 000) gallons per day. , .the <br /> design capacity is one hundred thirty-two thousand (132, 000) plus <br /> gallons. The report shows that even with the addition of thirty <br /> �' p �' <br /> six (3 6) lots at Shoestring Bay, assuming full build out of eight . <br /> hundred fifty-three (8 5 3) residential bedrooms. . .additional : : E <br /> capacity would. exist. <br /> Based on the foregoing. . .The Board finds for reasons <br /> enumerated. . . consistent with, and do not derogate from, the <br /> intent of the zoning bylaw. . . in general harmony with purposes and <br /> intents of the bylaw in compliance with provisions of M.G.L. <br /> Chapter 4 0A. . . furtherance of the public good and not <br /> substantially detrimental to adjoining land. <br /> Modifications: Willowbend authorized to construct the <br /> access road and utility connections per referenced Plans. . .thirty <br /> six (36) lots at the Shoestring Bay Estates will be connected to <br /> the Willowbend treatment plant, provided it is approve. by DEP. . . <br /> Decision does not constitute an approval under the Subdivision <br /> Control Law and the access road may not be used to provide 'E <br /> ' r <br />
