They believe lots 8 and 10 have interim <br /> waivers. <br /> Pat explained that was for the road, not water. <br /> Mrs. Antunes' daughter asked why did the town OK the wells on this <br /> property? We are paying for their oversight. <br /> Pat explained we are here to look at that tonight. <br /> Pat stated it is the Boards' understanding that water was to have been <br /> provided on that road and the applicant/owner asked that it not be <br /> provided . <br /> The applicant explained when the lots sell , they will then have the money <br /> to hook up to water. <br /> The hydrants will come with the water. <br /> Condition #13-marked boundary of open space. <br /> Conditions #15 it is not clear they have complied with the incorporation <br /> of a homeowners association, with mandatory membership. That is the <br /> paperwork in front of the Board this evening. <br /> ' Conditions #8 and 19 - no alteration of drainage easement, oil and gas <br /> separators in catch basins. <br /> They worked that out with their contractor (Joe DiMaggio) . <br /> Condition 20 and 21 -Deed restriction. That is also part of the paper wor <br /> presented tonight. <br /> The permit read that no lots can be sold or building permits issued until <br /> these conditions are met. <br /> The applicant explained their hands are tied until the water district <br /> brings water down Orchard Road . We have well tests from the wells in <br /> place. <br /> Tom said the Board of Health approved the wells so you can assume the test; <br /> were OK. <br /> The applicant stated they are trying to comply, what more does the Board <br /> need? Mrs. Antunes has said she will hook up to town water when the water <br /> is available. <br /> Pat explained the Board went through a long, involved process with this <br /> special permit. There was some benefit to the applicant and some to the <br /> town . The Board waived some standards in the applicants favor, with <br /> possible benefit but we allowed it. There is serious concerns about <br /> seepage form the dump, these private wells are subject to contamination. <br /> If the Board of Health says it is fine, we would like to hear it from them. <br /> The water that is OK now may have volatiles in later. <br /> A. <br /> The applicant stated their monitoring wells are a benefit to everyone in <br /> the town. <br /> ;i Tom explained one of the monitoring wells monitor the impact of their <br /> septic system on groundwater. <br /> 2 <br /> J <br />
