18 , 1994 . Decision filing due July 5 , 1994 . <br /> The hearing was opened at 7 : 05 p .m. <br /> Mr . Slavinsky was present but asked the hearing be continued <br /> until Mr . Hyde arrived . <br /> ** Pat made a motion to continue the hearing until Mr . Hyde <br /> arrived . Richard seconded the motion . All members were <br /> in favor 5-0 . ** <br /> DISCUSSION <br /> Applicant: Edgar Tobey/Terry Luff <br /> Location : Route 130/Map 28 , lots 5 & 6 , Map 36 , lot 11 <br /> Request: Discussion of potential rezoning from R-5 to C-2 <br /> Mr . Tobey and Mr . Luff were present . <br /> Tony explained that he and other Board members have been to the <br /> site. Charlie Rowley , consulting engineer has also reviewed the <br /> site . They all had the same reaction - it is a difficult site . <br /> He read from Charlie ' s letter - the site distance is limited . <br /> The property would be difficult to use for commercial purpose <br /> without significant re-grading . <br /> " Tony said the consulting engineer is very reserved about it . Tony <br /> i said he is also very reserved . <br /> +.� Mr. Luff explained they propose a minimal program, the parking <br /> lot can go anywhere on the site and the building can be turned . <br /> He asked what type of work do they have to do to continue this <br /> review? <br />' Tony responded they would have to engineer the project to show <br /> the Planning Board that it can work , including traffic study . <br /> The Board ' s reservation is about safety . That would have to be <br /> resolved . <br /> Pat asked if a safe line of site can be addressed on this site? <br /> ' Charlie said the issue is can they get adequate site distance to <br /> get in and out of the driveway safely? Will Rte 130 traffic have <br /> to stop abruptly? They will need safe visibility of 300 feet in <br /> both directions . Can that be achieved without going beyond their <br /> property limits? It ' s not the siting of the building or the <br /> parking lot that is the concern, its getting in and out of the <br /> property. <br /> Tony explained this area has a busy intersection and a big trip <br /> generator (Bayberry ' s ) . The work would require a lot of <br /> engineering without the guarantee of getting it re-zoned . <br /> Pat said personally , the idea is worth looking at . Historically <br /> the property was zoned commercial but it would mean taking the <br /> project a long way to see if it is feasible in this spot . <br /> Tom explained ultimately the project would need a curb cut permit <br /> from the DPW. <br /> 44; <br /> Tony explained , to the Board and to the applicant, that. the <br /> 'i Planning Board is being approached more and more with requests <br /> for re-zoning of property . He is not against it but the Planning <br /> 2 <br />
