Mashpee Zoning Minutes—March 22, 2000 6 0. <br /> Board of Appeals <br /> Mr. Regan questioned the people in the audience what their comments were. A resident <br /> of Deer Crossing complained about the condition of the gate and a crooked telephone <br /> pole in front of the ice cream stand. ,p ,, <br /> Mr. Borgeson asked the few residents from Deer Crossing about their feelings toward the r <br /> flea market. Several just said that the flea market"has always been there" and that"they <br /> don't notice it". Those in the audience agreed with Mr. Salvi that most of the trash is <br /> generated by people passing by the flea market. <br /> Mr. Salvi said that he was not contacted by the Zoning Board with any complaints ►�� ' I ' <br /> concerning the flea market. He contacted the other Boards in Town during the season <br /> last year and was told that they never filed any complaints. <br /> KIS <br /> Mr.Nelson said that the Building Commissioner is the Zoning Enforcement Officer. Mr. A �':A <br /> Hauck stated that the Building Department is so overwhelmed with work that his <br /> department is not getting all their work done now. He said that it is impossible to devote '° <br /> a certain amount of hours every day to monitor the operation of the flea market. <br /> Mr. Regan said he considers the flea market to be a priority and his main issues are the <br /> gate, front entrance and the hot dog shack. , <br /> Mr.Nelson stated that the Special Permit is in effect and that the Board can only vote to <br /> grant or deny the renewal to the modification to allow the tents and canopies to remain <br /> overnight. Mr. Regan said he was under the impression that the applicant is asking for a �. <br /> renewal of the Special Permit in its entirety. Mr. Brem asked if the Special Permit is for <br /> "perpetuity". Mr. Nelson said that is the way the original language reads. a <br /> Mr. Brem asked for the purpose of the Performance Security. Board Secretary read the <br /> decision regarding the release of the.Performance Security. Mr. Hauck said that the " <br /> money is deposited in a CD account. Ms. Elizenberry and Mr. Brem suggested that the <br /> money could be used towards the final clean up. <br /> Mr. Regan suggested an on-site meeting April 3, 2000 at 1:00 p.m. with the applicant,the i <br /> Board and Mr. Hauck. <br /> Mr. Regan moved to continue the hearing until April 12, 2000 to allow the Board to <br /> present the applicant with a list of things to improve the flea market. Mr. Regan also <br /> moved to ask Town Counsel if the applicant needs to come back on a earl basis to <br /> PP yearly <br /> renew the Special Permit or just to renew the Modification to the Special Permit. Mr. <br /> Brem seconded.
