Board of Appeals Dunkin' Donuts - Amancio S. Correia SP-97-26 2. <br /> I <br /> This Decision is issued by the Mashpee Board of Appeals pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and Sections 174- <br /> 25.E.1, 174-25.E.1 and 174-25.H.6 of the Mashpee Zoning By-law. <br /> Attorney Kevin M. Kirrane represented the Petitioner. He suggested to the Board <br /> that the use is permitted within the C-2 Zoning District and that the Petitioner had revised <br /> r <br /> his proposal to address all zoning concerns and issues. <br /> FINDINGS <br /> 1. The subject property is located at 401 Main Street (Route 130), Mashpee, <br /> Massachusetts. <br /> 2. The subject property contains 46,522 square feet. <br /> 3. The subject property is situated in a C-2 Zoning District. <br /> 4. The proposed use is a permitted use within the C-2 Zoning District upon the grant of <br /> a Special Permit from the Zoning Board of Appeals. <br /> 5. The original proposal (as modified) calls for the construction of a 2,023 sq. ft. <br /> building for use as a Dunkin' Donuts containing 24 seats, a drive-thru window, and <br /> 15 parking spaces. <br /> 6. Due to the Board's concern relating to traffic safety,the Board invoked the <br /> provisions of Chapter 593 of the Acts of 1989 and engaged the services of a Traffic <br /> Consultant, which consultant was paid for by the Applicant ($6,450.00) as required <br /> pursuant to said Chapter. <br /> 7. Bruce Campbell and Associates, Inc. was engaged by the Town of Mashpee to <br /> prepare a Traffic Impact Study, which study was presented to the Board on March <br /> 11, 1998. <br /> 8. Consistent with the findings and suggestions raised by Bruce Campbell and <br /> Associates, Inc. the Applicant modified his plan. <br /> 9. The site is both adequate and suitable for the proposed use and provides adequate <br /> land for parking. <br /> s <br />
