Public notice of this Hearing, as required, has <br /> been provided by certified mail. Exhibit B is a copy of the ., <br /> certified abutters list along with certified mailing cards. h>�. <br /> Exhibit A is a letter from counsel for Related Companies <br /> confirming the Purchase and Sale Agreement and the ability of the 1J <br /> Bornstein Companies as the prospective purchaser to seek rid";:uG <br /> Modification. <br /> Attorney Butler stated that he was in receipt of a copy of a <br /> letter from the Mashpee Environmental Coalition, addressed to <br /> Cape Cod Commission requesting the Commission review the ;yn <br /> possibility of this matter falling within Cape Cod Commission r!a <br /> jurisdiction. The Statutory provisions under Section 22 of the <br /> Cape Cod Commission Act have been reviewed and discussed with <br /> Patty Daily, Counsel for Cape Cod Commission. An analysis of <br /> the Grandfathering Provisions of Section 22 have been provided to <br /> the Board. It is Attorney Butlers understanding that the <br /> Counsel for Cape Cod Commission has concurred with said analysis <br /> and that the Commission, at this time, is not considering taking <br /> jurisdiction of this project. <br /> Thomas Fudala inquired if there was anything in writing from <br /> the Commission to this effect. Attorney Butler responded, °I do <br /> not have anything in writing from the Commission. I can provide ' <br /> you with a document if you think you want it. ,, (Tom Fudala <br /> thought he recalled seeing a letter; Attorney Butler stated that <br /> perhaps the Planning Department had received correspondence, <br /> but that he had not. ) <br /> Attorney Butler continued to say that he wanted to defer the , <br /> Fiscal Impact Analysis of the impacts of this Modification and of <br /> the project on the municipal finances of the Town of Mashpee. <br /> Just to highlight- -there have been discussions with the <br /> Accessor s Office and Superintendent of Schools. The 1994-95 <br /> Town Budgets have been reviewed, an analysis of tax revenue vs. <br /> cost has been done. Attorney Butler requested permission from <br /> the Chairman to defer this matter at this time, to which thei ;�► <br /> ai ri <br /> Chairman agreed. "►Ei r <br /> Attorney Butler stated that he and Mr. Bornstein met with a .jl9Ei <br /> group of the Condominium Unit Owners about one and a half months <br /> ago for the purpose of sharing copies of the Plans and for their ipf <br /> input. There has also been a subsequent meeting which Mr. � .e!4,,� <br /> Bornstein attended, Attorney Butler did not, which took place <br /> earlier this week.
