" + Board prior to requesting a building permit. Attorney McElhinney
r! , suggested a note or telephone call to the Building Inspector,
, l+i; informing him of the change and new plan would suffice, together
with a file notation.
h' '►1 Thomas Fudala informed the Board that he had spoken to the
, ,P•'id;'; Building Inspector regarding underground vehicle storage •y previously permitted under Special Permit; and the building issue
being discussed tonight.
John Kuchinski expressed concern regarding changes in
configuration on a recorded Plan.
Robert Govoni asked if a minor modification to a Special
Permit required a public hearing.
Patrick Coffey answered the Board has recently been advised
that clerical error would be considered a minor modification;
anything other than that would be considered major and would
require a new public hearing. (Which is the question on the
e,'i+I table tonight. )
Attorney McElhinney argued the basic building footprint of
Willowbend is not being changed, the square footage has been
B approved.
t` 4 Dennis Balzarini expressed concern because this change is
considered a new addition. (Discussion followed regarding
inclusion of language into the Permit which would build in a
procedure for approval of minor changes affecting the golf course
layout or without public hearing. )
The Vice Chairman asked for an informal poll of Board
Members: He has no problem with the request; Martine Meij ering,
no problem; Robert Govoni, no problem; Dennis Balzarini, no
problem with the issue of square footage, but has a concern with
the issue of conducting a public hearing; John Kuchinski, stated
'' '► . p1 he feels uncomfortable with said request being determined as a
minor change. There were no comments or questions from Thomas
Fudala, Eric Smith or Charles Rowley.
r ,►•' Patrick Coffey commented that the work done at Willowbend is
1 "V+ outstanding and a credit to the project and community. He
requested Applicant provide a Master Deed with "built-in
flexibility language" so that the Board would not be placed in
, 4a1 this particular situation, would prove to benefit everyone.
Mr. Besse stated an as-built Master Plan is nearing
completion, with some options on some of the remaining
properties.
4,
Attorney McElhinney stated there is, as part of the recorded
Special Permit, an overall Master Plan in terms of density.
i ,+ •p -10-
