r <br /> Tony explained that this proposal is dependant on whether it <br /> ` is acceptable to take the offered area of the subdivision <br /> _(14 lots) . The have not confirmed whether there is any <br /> merit to having this land. <br /> Tom stated he thinks the pluses are: A. Concern for the <br /> wetlands B. adjacent to open space in Cranberry Hollow <br /> subdivision, would not have to develop ancient way . f its <br /> together with open space corridor. <br /> Mr. Fallaci stated it can also be part of a future solution <br /> to the "alleged" water problem. Other developers could use <br /> that area to correct the problem. <br /> Tony stated that a lot more proper engineering should have <br /> been done originally and there were a lot of errors in <br /> judgement made . The plans were misrepresented to the Board <br /> originally. They must determine now how they will make up <br /> A. <br /> for it . <br /> The front two lots were a sales pitch and they should stay <br /> the way they are. <br /> He is not clear what the end benefit is to the Town to <br /> change anything. He is not happy with the stump dump, it is <br /> now a Board of Health matter. Before this can go any <br /> further the applicant must talk with other agencies involved <br /> with this and see what kind of violations were created. <br /> The Town will have the obligations of those violations if <br /> they ultimately take that piece of Land. <br /> He stated that he will not discuss the front lots any <br /> further. He will not be in favor of releasing those lots ,. <br /> Tom stated that he does not see any safety problems in <br /> releasing the ,front -two lots and would he would rather see a <br /> contiguous piece of open space than houses on those front <br /> lots. <br /> Judystated that there was a gross discrepancy between what <br /> was delineated as wetlands and what actually exists as <br /> wetlands . Had they been properly delineated on the original <br /> filing there would be no lots there to begin with. <br /> 40 <br /> John Falacci stated that they were not involved in the <br /> design of the subdivision. The planning Board approved it, <br /> their engineer and all other agencies reviewed it. They <br /> have been the only ones to help resolve a "problem"' , which <br /> they do not think is a problem. I t, does not occur only on <br /> their property. They have not been able to reach a solution <br /> so they are offering land for the Town because they feel the <br /> Town is just as responsible as they are for approving the <br /> plans . They are trying to deal with the problem. <br /> -Tony stated that the plan was misrepresented to the Torn. <br /> It was approved on information that was misrepresented. <br /> Tony explained to the applicant that he should go to the <br /> Board of Health, Cons Com and DPW and ge t letters S ayin a <br /> they don' t have any problems with the ToT-?n receliving <br /> lots . <br />
