16 Great Neck Road North <br />Mashpee, Massachusetts 02649 <br />Virtual Workshops <br />Mr. Lehrer reached out to the Superintendent for the virtual workshop for parents of school age <br />children. Ms. Waygan would like a three week notice for this. If this is to be held in September, Mr. <br />Lehrer is on vacation the week of the 11 to-17tn <br />Ms. Waygan noted if these workshops go on, we will have the survey then. If we miss someone while <br />we are gathering the data we will have the survey to rely on. <br />Mr. Lehrer stated Mr. Beltran was stationed at Mashpee Commons, the Community Concerts on <br />Tuesdays, and on the spot engagement sessions. He will be at the Senior Center BBQ on July 29tn <br />Algonquin Land Clearing — Informal Jurisdictional Interpretation from Cape Cod Commission <br />Ms. Waygan commented there was something in the packet from the Cape Cod Commission, a deferral <br />as a DRI won't work. <br />Mr. Lehrer stated that was their informal jurisdictional interpretation. There is a process in the Cape <br />Cod Commission Act that would allow for a formal interpretation that would go to the full Commission. <br />The informal jurisdictional interpretation is a staff review of the facts and relevant information. They did <br />send some questions to Town Counsel, and after Counsel replied this is what is tasked relative to a <br />mandatory referral. <br />Floodplain Bylaw amendments <br />Mr. Lehrer provided the Board with the final copy this evening. There are no longer redundancies. He <br />contacted the Barnstable County Flood Plain Coordinator relative to restricting the use of fill and she <br />was overwhelmingly supportive in that endeavor. It will give them more credit in the Community Rating <br />System. Chatham is the only other town on the Cape who does this. He inserted a new section titled <br />prohibitions 174-67, it states that no person shall fill, dump, or place in a floodplain any soil, sand, <br />gravel, or rock or other material substances such as refuse, trash, debris or any dredge material with <br />exception to landscaping material, as allowed in section 174-61 of this bylaw. Creating landscaping <br />material exceptions includes at structures that taper to meet the natural grade of the foundation and <br />additionally the use of rock for purpose of reconstruction or dredge for beach nourishment. In the draft <br />he sent the Board last week, he forgot to place language in the prohibition section that no letters of map <br />revision based on fill will be permitted. If you proposed a substantial improvement to your property and <br />want to raise it out of the floodplain with compacted fill, previously you could submit a request to FEMA <br />that modifies the flood maps. This states that is no longer permissible. The other thing he wanted to <br />note with the prohibition of fill in all flood zones, you can't build a basement beneath the base flood <br />elevation of any floodplain. An Issue was raised about solid wall foundations with flood vents, in areas <br />of raised and replace, crawl space, or cinder blocks. Prohibiting the use of fill gets at that issue. You <br />can't dig a full basement in a flood plain. By raising it out you can, but a solid wall foundation or stilts <br />would remove the basement. With the Board's approval, this is ready to submit to the Select Board. It <br />has been thoroughly vetted by the BCFPC. It is also consistent with the administrative requirements by <br />19 <br />
