40B discussion meetings and felt that his input was not well received; and that upon <br /> advice from legal counsel,it was the Applicant's understanding that the Planning Board <br /> had no jurisdiction over this project. <br /> Thomas O'Hara recognized that this is a major project and spoke to the time <br /> element. lie also stated he could not attend meetings during the daytime. However,he is <br /> very interested in participating in this project as he lives nearby and,is interested in the <br /> impacts for himself and his neighbors as well. He expressed concern with the amount of <br /> information involved and the overall scope of the project being addressed at a Planning <br /> Board Meeting and the appropriate time to address,other agenda items. <br /> The Chairman suggested regularly scheduled Planning Board Meetings begin at <br /> 6:00 p.m. in order to address this matter exclusively. She also suggested a format for the <br /> meetings be determined. As the Cape Cod Commission is a party to the Development <br /> Agreement she suggested representatives attend. <br /> The Town Planner suggested that overall wastewater and traffic impacts of the <br /> project upon the entire,Town be examined. He asked Mr. Storrs when he expected to <br /> file the application with,the Cape Cod Commission in order to formally begin the <br /> Development Agreement process. <br /> Mr. Storrs replied by stating he intends for file the application "further down the <br /> line"'. <br /> The Town Planner suggested the Board begin the discussions with their concerns <br /> and those of the community. <br /> It was agreed that discussions would begin on Wednesday,June 4, 2008 at 6:00 <br /> p.m. and would include representatives of the Cape Cod Commission and the Consulting <br /> Engineer, <br /> Release of Perforniance Guarantee <br /> Peter Hopple— 10 Balfour Lane <br /> The Chairman called this matter to order and recognized Peter Hopple. <br /> Reference was made to a letter received from Mr. Rowley dated May 21, 2008, <br /> regarding Balfour Lane at Silverleaf Lane outlining five items of concern. <br /> The Town Planner made reference to the Minutes of the September 5, 2007 <br /> Planning Board Meeting discussion of this matter as requested by Mr. Hopple. The <br /> amount of security being held on this,property is Two'Thousand($2,000.00)Dollars. <br /> Mr. Rowley made reference to pictures of the property explaining that the road <br /> materials wash away From the hill during a rain ston-n; the same materials are disturbed <br /> when the roadway is plowed and deposited into the intersection.
