Expiration, Extension or Modification— The following sentence was <br /> deleted: "The applicant shall require a specific determination of good cause by a <br /> favorable vote of four member of the Planning Board if claiming an extension of the 2- <br /> year period, except to wait the determination of any appeal from the grant hereof" <br /> "Any modifications of this Special Permit Decision and accompanying plans, 'or <br /> an extension of the 2-year lapse period , shall,require approval by the Board pursuant to <br /> the provisions of Section 174-24.C(9) of the Zoning Bylaw." <br /> The Board commended the Town Planner for producing such an excellent draft, <br /> document in a relatively short period of time. <br /> There was brief discussion including modifications to text changes, road <br /> issues/DPW Sedimentation Town Bylaw, Federal Permits, and live/work spaces <br /> incorporated into the, 40B project. <br /> Having determined there were no Public comments, the Chairman entertained a <br /> motion. <br /> M_OTION., Dennis Balzarini made a Motion to approve the draft Decision <br /> document as presented; which Motion was duly seconded by Thomas O'Hara and so <br /> voted unanimously. <br /> Voting in Favor: Beverly Kane, Dennis Balzarini, Thomas O'Hara and Joseph <br /> Mullin, <br /> Having determined this to have been the free act and deed of the Planning Board, <br /> the Board Secretary notarized one original and four copies of the Special Permit Decision <br /> Jobs-Whiting Trust Mashpee Commons—Jobs and Whitings Road--Commercial Space, <br /> as signed by the Planning Board Chairman, Beverly Kane, <br /> 4 <br />
