Attorney Schilling presented a covenant Form D disc! to Tom <br /> Fudala. He explained the first six are identical statutory <br /> covenants. Number seven states that LotS 5, 6, 7 and 8 are <br /> subject to the Covenant. <br /> (At this point reference was being made to Subdivision Plan <br /> of Land located in Mashpee, MA, Lots 5 through 8 have legal <br /> frontage on Fern Gully Pass, Lot 4 is not subject to the <br /> Covenant . ) <br /> Attorney Schilling further explained that number 8 states, <br /> . . . "No building permit shall issue for any lot on the herein <br /> described subdivision plan until such time as the Certificate of <br /> Revival for P,adderborn Development Company, Inc. and a grant to <br /> the Easement from Padderborn Development Company, Inc. to Robert <br /> H. Plugge over a portion of Childs River East land being shown as <br /> an Easement located between Lots 19 and 20, crossing Lot 65, as <br /> shown on Land Court Plan 38104C are recorded with the Barnstable <br /> County Registry of Deeds . This Easement shall not allow for any <br /> further grants of rights of way over the same. A copy of both <br /> documents to be delivered to the Planning Board of the Town of <br /> Mashpee. 11 <br /> Attorney Schilling presented one signed copy of the Covenant <br /> to the Planning Board. The Chairman requested he give it to the <br /> Town Planner for his records and forward to the Planning Board a <br /> copy of an original signed duplicate Covenant as recorded with <br /> Barnstable County Registry of Deeds indicating Book and Page. <br /> The Chairman introduced a written request for necessary <br /> road construction waivers, <br /> (There was brief discussion among the members of the Board <br /> regarding any conditions or previously agreed upon requirements <br /> in this matter. ) <br /> There was some discussion regarding Plan of Land entitled, <br /> Childs River Estates-John Amos Road Profile . <br /> MOTION: Patrick Coffey made a motion to approve waiver <br /> Request; said motion was, seconded by Dennis Salzarini and so <br /> voted unanimously. <br /> The Chairman opened the discussion to any public questions <br /> or comments on the matter of the Childs River Estates Covenant. <br /> Mashpee Resident: Asked about the status of the Easement <br /> to Mr. Plugge. <br /> The Chairman explained the Planning Board has received from <br /> the Applicant and his attorney, a Certificate of Revival- <br /> Padderborn Development Corporation, as well as a specific <br /> Covenant which will enable Padderborn Development, Inc. to <br /> -7- <br />
