Dennis Balzarini made a Motion to approve the release ofthe <br />Perfbrmance Guarantee in this matter in the arnount of Thirty -Six Hundred ($3600.00) <br />Dollars; which Motion was duly seconded by Thomas OHara and so voted unanimously. <br />Public Hearing <br />Cotuit Equitable Housing I..,LC - Noisy Hole Road <br />'Modification of Definitive Subdivision Plan for Noisy Hole Road related to <br />Cotuit Meadows 40B Project <br />The appointed hour having arrived the Chairman read the public blearing notice <br />into the record and called the Public Hearing to order. She recognized Matthew Eddy, <br />Baxter and Nye Engineering & Surveying, representing the Applicant. <br />Mr. Eddy introduced John Kenney, Attorney and part owner of the project. <br />Mr. Eddy then infibri-ned the Board that all of Mr. Rowley's comments have been <br />addressed and that revised plans have been subnaitted to the Board, <br />With regard to the matter of the paving of the extension of Noisy Hole Road, <br />Applicant proposed the paving of 18-ft- the Planning Board requested 20-ft. The <br />developer has agreed to the paving of 20-ft. as noted in the said letter and revised plans. <br />The two items remaining for discussion and agreement are the intersection design <br />phasing of Route 28/Noisy'Hole Road, which is being reviewed by Mass H ighway; and <br />the sidewalk/Noisy flole Road matter. <br />Mr. Eddy explained that a layout and design has been submitted for an interim <br />intersection, identified as Exhibit "A-, for discussion Purposes, As part of the design <br />process with Mass Highway, after a certain number of units has been constructed and/or <br />after a certain tinieframe the signalized intersection has not been constructed, said Exhibit <br />"A" would be installed. Applicant is also looking to Mass Highway for approval of a <br />curb cut access. <br />Applicant is proposing a four (4) year tirrieframe for aflull signalized intersection <br />before being required to, install said interim intersection. Mr, Rowley has suggested a <br />tirneframe of two (2) years, or upon completion of the sixtieth ullit within the <br />development, <br />Mr. Eddy suggested a compromise, perhaps a three (3) year tirriefrarne/sixty (60) <br />unit count, Applicant intends to rnoveforward with Mass Highway and plans to meet <br />with them within the next thirty (30) days. The Barnstable comprehensive permit has <br />conditioned the design of the intersection be submitted and finalized with Mass Highway <br />within one year.
