Mr. Lehrer got the sense at the first Public <br />Hearing there was a perception the applicant was seeking relief. He is correct about R3 having <br />a minimum lot size of 40,OOOs.f. Mashpee requires any lots to be divided in excess of 5 acres, <br />must be subdivided into cluster configurations. This requires the applicant to have smaller lot <br />sizes and a Special Permit where this Board has the authority to allow a special set of criteria <br />for this parcel to pass. These smaller lots are allowed in exchange for open space. <br />Mr. Stark continued talking about the shacks that abut his property, one is an old house, and <br />the other a shed. There is history in that house that should be looked at. That totem is a <br />historic pole that belonged to Princess Evening Star. There are many buildings on the property <br />and who knows what else. Now New Seabury, LLC, a billion -dollar corporation that took over, <br />look what they have already done to Mashpee. Those cottages are atrocious. That was <br />grandfathered and now ICON (New Seabury, LLC) is selling everything they have now. They <br />are disrupting our neighborhoods. A huge piece of that land is unbuildable, a gigantic hole, a <br />piece of property that would cost a lot to fill. The reserve land is unbuildable, it's a kettle hole. <br />They know they can't build on it, they are not giving up anything. ICON is done on the New <br />Seabury side, now they want to come over and build the last 6 or 7 on this side of the road. He <br />doesn't see why we should let them; they have money, and they will fight. He has 3.5 acres, <br />and the house next to him is for sale at 2 acres. Can he come back and say he wants to build <br />3 houses on his property, one acre a lot with 75 ft. of frontage, he has 150 ft. for frontage, he <br />could build a road. <br />Ms. Waygan explained the idea behind promoting the cluster subdivision is to get open space. <br />Mr. Stark commented they have 100 acres of federal wildlife refuge, they have enough open <br />space and don't need New Seabury's hole. <br />Ms. Waygan elaborated that this is a bylaw that got approved at the Town Meeting. Her first <br />look at this was to put conditions on this property, it is allowed, and we haven't finished our <br />review, haven't addressed all comments, she hasn't made her decision yet, but she hasn't <br />seen any huge barriers to going forward. This is the current bylaw, regardless of who owned it. <br />She wants to hear how this impacts neighbors. <br />Mr. Stark reminded the Board about his neighbor the war veteran with PTSD, construction and <br />all the trucks over the course of 2-3 years would affect him tremendously. He feels as though <br />the residents are not being cared about. They are here to fight this, and the only consideration <br />is the bylaw in place. He doesn't understand the need to build, that will disrupt a good size <br />neighborhood and give us a kettle hole. The whole property has historical value, to just come <br />in a build 7 houses doesn't make any sense. He used to do a lot of work in New Seabury for <br />the peninsula council, and he used to see deer and fox, all kinds of wildlife. When they built, <br />they pushed the wildlife onto our side.
