16 Great Neck RoadNorth <br />-Mashpee, -Massachusetts 02649 <br />Mr. Fudala stated there were pictures sent in of the tree needing to be cut down. The previous <br />owner built this concrete patio in violation of the special permit. The patio impedes on the tree <br />and is not in code. <br />Ms. Waygan would like to see that tree go down, it has pine beetles. <br />Ms. Faulkner stated if this tree has beetles it is not a good looking tree. Let the owner put <br />another protected tree on the property, and it doesn't have to be there. <br />Their horticultural ist will suggest the tree and location to the Planning Board, as to not fall on <br />the house. <br />Partial Release of Covenant for 12 Cypress Circle identified as "Reserved Recreation <br />and Green Area" on the plan entitled "Conaumet Highlands Subdivision Plan of Land in <br />Mashpee Mass" recorded in the Barnstable Registry at Plan Book 256, Page 71. <br />Covenant was previously released on March 20, 2024 under different owner name. <br />Registry requires a new release under the names of the current owners, per Town <br />Counsel. <br />MOTION: <br />Mr. Balzarini made a motion to authorize the Planning Board to execute and sign <br />the partial release of the Covenant for 12 Cypress Circle new release due to the <br />addition of another name on the Title. Seconded by Mr. Richardson. All in favor. <br />Release of Covenant dated June 1, 2010 for the original 5-lot April 21, 2010 version of <br />Willowbend's "Willow Circle" subdivision, which was revised to 6 lots by plan dated <br />December 13, 2021, whose Covenant was released on January 18, 2023. <br />The 5 lot Willow Circle covenant was signed by the then Board, and it turned into a 6 lot Willow <br />Circle plan for which the covenant was recorded. The already released covenant needs <br />another one to satisfy that there isn't another covenant that will infringe. <br />MOTION: <br />Mr. Richardson made a motion to sign and release the covenant. Seconded by Mr. <br />Balzarini. All in favor. <br />BOARD ENGINEER REPORT <br />Mr. Pesce reached out to Jacque Morin before last meeting in September about his good faith <br />gesture to fill in the potholes. Mr. Morin sent pictures today of a half dozen sites with gravel <br />and recycled asphalt. It will last another month, but he did it as a gesture. It will start to <br />deteriorate in 6-8 weeks. <br />5 <br />
