MEETING MINUTES <br /> JANUARY 8, 2025 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Mr. Ganzenmuller made a motion that the Board issue a Special Permit under §174- <br /> 17.1 and §174-33 for 17 Monomoscoy Road West to Owners, Biria D. and Elaina C. St. <br /> John, Trustees of the Biria St. John Trust to raze a pre-existing, nonconforming <br /> single-family residential structure and replace it with a new single-family residential <br /> structure on property located in an R-3 Zoning District, Map 114, Parcel 20, <br /> Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Special Permit under Mass General Law 40A Section 9. <br /> 2. Plot Plan - Proposed Improvements for 17 Monomoscoy Road West, Prepared <br /> for: Biria and Elaina St. John, Plan Date: November 20, 2023, Plan Scale: 1" _ <br /> 20', Revision Date: 12/18/24: Add dimensions requested by Building <br /> Commissioner (depicting 150 ft. distance from the furthest corner of the new <br /> structure), 3/6/24: Revise House, Drive, Lot Coverage, SAS, ACEC, Add 75 ft. <br /> and 150 ft. buffers, Generator, and remove vertical wall. Prepared by Falmouth <br /> Engineering, Falmouth, MA. Stamped and signed by: Michael Borselli, Civil <br /> Eng. No.: 35054, and Gary Labrie, Land Surveyor, No.: 40039, 3/13/24. <br /> 3. Conditioned that the applicant seek and obtain the Building Department review <br /> in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the <br /> application of a building permit. <br /> 7. The Board finds under §174-17.1 and §174-33 that the proposed project as <br /> submitted is not substantially more detrimental to the neighborhood than the <br /> existing conditions prior to removal of the existing structure, and that there is <br /> adequate land area on the subject lot to provide sufficient parking, and there <br /> are no new nonconformities being created. <br /> 10 <br />
