PLANNING BOARD <br /> Town of Mashpee <br /> 11Ir. Blakeman said ,you have dot facilities on Route 28 that attract transients g <br /> "On the Rocks", Driving Range and Mini Golf. <br /> Kr, Bourgeois said. that Pr. Benway mentioned a two-year moratorium and he <br /> (Tom) didn 't know if he 's for It or not, Mr. Blakeman mentioned that that would <br /> just be on the stuff that's undeveloped - large acreage at this point -- lots that <br /> are just sitting there. Mr. Blakeman wanted to know if it could be done legally, <br /> especially on changes within the undeveloped land. Me also said that if somebody <br /> has 50 acres, you're saying that you're going to stop them for two years m they've <br /> already gone through a two-year moratorium because of the suit and now you're going <br /> to stop them for another two years. He said that he would suggest that you're <br /> going to have to give them some compensation beyondthat, that the banks will still <br /> be after their mortgages, he said it would be a hardship on people with a big <br /> chunk of land m he asked how long can some people not do something with their hand <br /> and he further questioned whether it's legal. <br /> Mr. Benway explained the legality of the moratorium to Mr. Blakeman, adding <br /> that it will Freeze any further subdivision of undeveloped land for the period of <br /> time that we want, Mr. Blakeman said that these same people have had a two-year <br /> moratorium in which they haven't been able to do anything. He TTanted to know if <br /> putting another two years on it, is the town willing to say "zero taxes" and will <br /> the banks say "zero interest and zero principle." <br /> Mrs. Ralkeman said that -ou're denying the right of someone to use that land <br /> and Mr. Blakeman asked what the town is willing to give in exchange for it. Mr. <br /> [, Benway said that maybe the town would give a tax breaR, adding that the overall <br /> intention is the interest of the tour. Mrs. '�lakeman said that you also have to <br /> consider the individual. Mrs. Thomas pointed out that meanwhile you might be de- <br /> veloping a plan and the suit might go on for another two years anTray. Mr. Ben- <br /> way said that every case will probably be different and there may be some in- <br /> equities - it has to be done to protect the town. He also said that it's going <br /> to be the subject of a zoning study. <br /> Chief O'Connor said that if it's subdivided into half-acre lots and he could <br /> get funding and he could purchase it ® if the proposal is a two-acre rrti ninrum - if <br /> that went into effect tomorrow m then, he asked, he wouldn't be able to purchase <br /> that half-acre? He was told that he could purchase it, that anything that exists <br /> now is protected. <br /> Mr. 9enway said that the Planning Board would be bombarded when the word gets <br /> out - if the towm is going to consider a moratorium, a bunch of people will be <br /> hopping. All we can do according to counsel, is have a bearing on the bylaw pro- <br /> posal an whether it's a moratorium or going to 80,000 square feet, pending a study <br /> they can hold on and trait until the study comes out. The bylaw has to be heard be- <br /> fore it gets to a Special mourn meeting. <br /> Mr. Blakeman said that for the past two years our hands have been tied. and <br /> nov another two years. They can still do something with their 60,000 or whatever. <br /> Mir, Benway sa-d they can't do anything until the title gets clear. anyway - if it took <br /> a year for the 't;itle, they would only have another year -to go. Mrs. Blakeman wanted <br /> to knot..r who would buy if there's a moratorium on it and Mr„ --3&nway said that if the <br /> price was low enough, it would sell. He also said that his priority is the -town. <br /> Mrs. Blakeman said that the town is made up of people m you have. to think of the <br /> 8 <br />
