MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Samuel Peter Delois and Patricia Jean Delois <br /> 4 Pond Street, Map 117,Parcel 257 <br /> Mashpee, MA 02649 <br /> SP-2024-39 <br /> Attorney Kirrane stated that the new structure build will be decreasing. The existing structure is <br /> 1,940 sq. ft., and will reduce to 1,732 sq. ft. The existing percentage of lot structure coverage is <br /> 24.9% and will decrease to 22.3%. The 20.4 ft. front yard setback to Pond Street is being <br /> eliminated, and will become conforming at 25.7 ft. The rear yard setback will remain the same at <br /> 12.6 ft. <br /> SPECIAL PERMIT FINDINGS <br /> The subject property located at 4 Pond Street contains a total of 7,774 square feet of land. The <br /> minimum dimensional requirements in the Popponesset Overlay District are as follows: <br /> Minimum Lot Size—6,000 square feet <br /> Minimum Frontage—60 feet <br /> Minimum Front Yard Setback—25 feet <br /> Minimum Side and Rear Yard Setback— 15 feet <br /> There were no abutters present. <br /> The Board of Health comments dated August 9, 2024 were read into the record; "No comment to <br /> remain 3 bedroom with the addition of YA septic system per Mashpee 1000 foot YA regulations." <br /> The Conservation Department comments dated August 12, 2024 were read into the record; <br /> Resource Areas: Bordering Vegetated Wetland(BVTF9 &LSCSF, N©I application was approved <br /> with a 3-1 vote due improving water storage capacity onsite, drywell install, flood compliant <br /> basement, L4 septic upgrade, and creation of naturally vegetated areas where none existed prior." <br /> Chairman Bonvie confirmed there will be a reduction in lot coverage, one nonconformity will <br /> become conforming, and there are no new nonconformities being created. <br /> Attorney Kirrane stated the one nonconformity which is the 12.6 ft. rear setback and will remain <br /> the same. The lot has two rear yard setbacks and two front yard setbacks but there is no <br /> intensification of the existing nonconformities, and no new nonconformities are being created. <br /> The Board made the following findings: <br /> New construction will comply with current building code criteria. <br /> New construction will comply with current flood zone requirements. <br /> Drywells are being proposed. <br /> A new I/A septic system will be installed and was approved by the Board of Health. <br /> • The overall structure coverage is decreasing from 1,940 sq. ft.to 1,732 sq. ft. <br /> 2 <br />
