MINUTES October 7, 1993 5 BOARD OF HEALTH Mr. Greelish relayed, "Due to the strip-out that is re- quired and variance relief sought I would be inclined to deny the requested relief. " Mr. McDonald stated, "There are houses all around this lot of this scale or larger. " Mr. Greelish commented, "There are existing structures there, sometimes the data brought to us are somewhat biased in one direction or the other or test results that are unfa- vorable but not submitted. " "In the past due diligence was not the hallmark of this Board but it is now. " "Most of the property in the vicinity is low lying and marginal. " "This area, as well as, other areas have ground saturation condi- tions in the soil . " Mr. Doherty relayed, "It is a matter of physical space not being there. " "This Board will not permit a leaching fa- cility within 100' of the wetlands and the separation from groundwater is just 4' . " "The problem with that is the mate- rial in between is very questionable, it's not all good per- meable soil it is mixed with impervious material. " "There is -an. - abutter on oneside who- objects- to the installation of a retaining wall along his property line which must be recog- nized as a valid objection. " Mr. Ojala questioned Board members as to what type of pollution the Board is concerned with. Mr. Doherty responded, "This Board is concerned with the 100' distance requirement from the wetlands and 4' of naturally occurring permeable soil between the bottom of the leaching facility and groundwater. " "We will not approve mounded or striped-out systems to be constructed where soils are unsuitable. " Mr. Ojala questioned Board members as to whether the Board would approve the installation of a denitrification system. Mr. Doherty relayed, "The denitrification systems are still experimental . " "None of them have been proven and there is no way to quantify the benefits in terms of a trade-off with distance. " Attorney O'Connor stated, "Systems like Bio-Clear has received a site-by-site approval . " "We would be willing to be subject to the installation of such a system. " Mr. Greelish explained the reasoning for distance re- quirements between a body of water and a leaching facility.
