" "You are not allowed to arbi- <br /> trarily create your distance whenever you need it. " <br /> Mr. Michniewicz relayed, "There is a specific provision <br /> in Title V for the allowance of construction of septic sys- <br /> tems in fill. " <br /> Mr. Greelish responded, "Not to meet that distance. " <br /> "The distance below that is significant. " <br /> Mr. Doherty explained, "The town did implement that <br /> by-law in order to clarify that so that there would be no fu- <br /> ture argument over it. " "The area that were are talking <br /> about, (Popponesset) , the lots are very small and there are <br /> so many septic systems that were placed in there over the <br /> years that the entire ground area is saturated with <br /> sewerage. " <br /> Mr. Michniewicz questioned, "If through investigation_ <br /> - and through the use of experts a case could be made to show <br /> that the same level of environmental safe guard is provided <br /> through the use of placed fill to create the 4' thick strata <br /> would the Board consider granting the relief sought by Mr. <br /> Rossetti . " <br /> Mr. Doherty stated, "We cannot trade off distance for <br /> almost proven systems. " <br /> Attorney Mills questioned Board members as to whether <br /> they would consider the use of a Clivus system in conjunction <br /> with an approved Title V system. <br /> Mr. Doherty responded, "We have run into problems where <br /> the effects of a gray water system have not been quantified. " <br /> "A zero discharge removes any question however, a partial <br /> discharge is still questionable. " <br /> Mr. McQuaid stated, "Mr. Al Warren, (abutter - 48 Clover <br /> Lane) , called and indicated he intended to attend tonight and <br /> voice his opposition to any Title V variances however•, became <br /> ill and would like to go on record as opposed and will for-- <br /> ward a letter indicating his opposition. " "Mr. Warren also <br /> indicated should the Board consider granting any Title V <br /> variances that they do so conditional upon review of his let- <br /> ter. " <br /> Mr. Michniewicz relayed, "Mr. Warren contacted me this <br /> afternoon. " "I explained the particulars of this septic sep- <br /> tic and the variances requested. " <br />
