MINUTES October 13, 1994 S BOARD OF HEALTH <br /> Mr. Ball stated, "I am basing it on the fact that he is not the original developer." <br /> "I don't think we had enough information last week to even vote on this." <br /> Mr. Doherty stated, "Things change." "When the original developer built this we <br /> did not have town water there." "It goes against our policy where water is available town <br /> water is the only approvable source." "Are we arguing the technicality of availability?" <br /> Mr. Marsters stated, "I would like to argue that point if I could." "I would say <br /> that town water is available to this property here coming down Dover, no question about <br /> it." "It is not available down the Windermere side down here." "Let's take another <br /> instance, I'm trying to think of a house that I had that is a corner lot." "I lived on the <br /> corner of Meadowbrook and Monomoscoy." "Say Monomoscoy was down here and <br /> Meadowbrook was right here, the water comes down Monomscoy here so technically, I'm <br /> paying my betterment, you are absolutely right because they are getting me on the side, <br /> it's not coming in the front." "But, nobody down Meadowbrook, the next lot removed <br /> can't get water down Meadowbrook." "They are calling that not available." "Isn't this <br /> the same incident as where my own personal residence is in right now, not available." <br /> Mr. Cram questioned, "Are you talking about being double charged based on it <br /> being a corner lot?" <br /> Mr. Marsters responded, "No, I am talking about it's not available the next lot <br /> removed down." "This is the next lot removed down, same circumstance." "It is not <br /> considered available to me." <br /> Mr. McQuaid stated, "Maybe this is something we should look into." <br /> Mr. Marsters stated, "We definitely should, but as of right now it is not available." <br /> Mr. McQuaid stated, "The same development with vacant lots remaining to be <br /> built in Seabrook Meadows where water's available on Monomoscoy but not down the <br /> side streets." <br /> Mr. Marsters stated, "Right, and if town water did want to come down from that <br /> one lot removed you would have to petition the owner's to see if more than 50% want <br /> town water." "If that is the case wouldn't we have to petition 50% of the owners if they <br /> wanted town water down here too." "They have already been asked once and they didn't <br /> want it." "I'm not saying they don't want it now but shame on them for not taking it the <br /> first time." "So that incidence that I am living in right now as in any other subdivision that <br /> you deal with when town water comes down here but not this side is no different from this <br /> one right here and that is considered non-availability." <br />
