MINUTES October ;13, 1994 9 BOARD OF HEALTH
Mr. Doherty questioned, "How do we compel these people to hook into town
water?" "When you have a lot that's not built then you have the opportunity to essentially
dictate the source of the water either well or town water."
Mr. Marsters commented, "If it is available."
Mr. Doherty relayed, "We think that it is reasonably available presently, at a cost."
"I suppose that is what we have to come to grips with." "What is reasonable availability."
"It is reasonable to expect him to try to chase down an easement so that he can run a line
in?" "I don't know, maybe not"
Mr. Marsters stated, "I am naieve to town water believe it or not." "Is there an
easement for water here." "It may be on this one here because SO% of the owners wanted
to come down here and they did it." "My question - is there an easement for town water
even right here?" "I don't know that."
Mr. Cram questioned, "Is the person that as a developer on this originally, when he
designed this was this not a stipulation that an easement had to be granted for all
individual lots?"
Mr. Marsters responded, "That I do not know only because I did not even know at
that time that there was town water down there." "So I don't know the answer to that
question."
Mr. Doherty questioned, "When did you buy the lots."
i
Mr. Marsters responded, "Two years ago."
Mr. Doherty stated, "On July 26, 1994 there is a plan submitted, on behalf of Prime
Properties, by Aro Eng. showing water service."
Mr. Marsters stated, "That was a big boo-boo on our part." "We had no idea that
there wasn't water down there."
Mr. McQuaid stated, "It's a big boo-boo that maybe you have to...."
Mr. Ball stated, "But on the other lot it shows a well."
