"When you have a lot that's not built then you have the opportunity to essentially <br /> dictate the source of the water either well or town water." <br /> Mr. Marsters commented, "If it is available." <br /> Mr. Doherty relayed, "We think that it is reasonably available presently, at a cost." <br /> "I suppose that is what we have to come to grips with." "What is reasonable availability." <br /> "It is reasonable to expect him to try to chase down an easement so that he can run a line <br /> in?" "I don't know, maybe not" <br /> Mr. Marsters stated, "I am naieve to town water believe it or not." "Is there an <br /> easement for water here." "It may be on this one here because SO% of the owners wanted <br /> to come down here and they did it." "My question - is there an easement for town water <br /> even right here?" "I don't know that." <br /> Mr. Cram questioned, "Is the person that as a developer on this originally, when he <br /> designed this was this not a stipulation that an easement had to be granted for all <br /> individual lots?" <br /> Mr. Marsters responded, "That I do not know only because I did not even know at <br /> that time that there was town water down there." "So I don't know the answer to that <br /> question." <br /> Mr. Doherty questioned, "When did you buy the lots." <br /> i <br /> Mr. Marsters responded, "Two years ago." <br /> Mr. Doherty stated, "On July 26, 1994 there is a plan submitted, on behalf of Prime <br /> Properties, by Aro Eng. showing water service." <br /> Mr. Marsters stated, "That was a big boo-boo on our part." "We had no idea that <br /> there wasn't water down there." <br /> Mr. McQuaid stated, "It's a big boo-boo that maybe you have to...." <br /> Mr. Ball stated, "But on the other lot it shows a well." <br />
