MINUTES November 3, 1994 5 BOARD OF HEALTH <br /> proposed garage, the existing well will be abandoned, town water will service the dwelling <br /> and the smaller cottage will be disconnected from any leaching facility which services the <br /> proposed larger dwelling, Mr. Ball seconded. <br /> APPOINTMENT: William Haney - Lakeside Trailer Park <br /> Mr. William Haney was in attendance for this scheduled appointment. <br /> Mr. McQuaid stated, "A few weeks David Sanicki on behalf of Mr. Haney <br /> submitted a proposed agreement dealing with the verbal agreement that we have with Mr. <br /> Haney that he would upgrade five septic systems per year including emergency failures <br /> pursuant to his agreement with the Board when he purchased the property." "The Board <br /> was not comfortable with the agreement as originally proposed." "Mr. Sanicki <br /> subsequently added the paragraph at the bottom of September 15, 1994 letter which states <br /> that, "MEZ Realty, Inc. will complete five new septic systems including emergency repairs <br /> per calendar year" and further stated, "This understanding is as long as the corporation <br /> has the funds available to replace the septic system"." "When this was presented to the <br /> Board it was uncomfortable with it and denied to agree to the agreement." "Instead the <br /> Board requested I reword that last paragraph to read, "MEZ Realty, Inc. will complete <br /> five new septic systems including emergency repairs for the calendar year, this <br /> understanding is in effect until October 13, 1997 the date by which time D.E.P. has <br /> mandated that the park be connected to town water"." "When this issue was brought up <br /> two weeks ago I indicated that Mr. Haney had come in that afternoon and was willing to <br /> come before the Board to present his side of the story." "I further indicated that one of <br /> his concerns is potential rent control." "If rent control were instituted it may financially <br /> prohibit Mr. Haney from complying with his agreement of five new septic systems a year." <br /> "Mr. Doherty was opposed to giving that time frame and requested I reword that last <br /> paragraph." "I represented Mr. Haney's point of view being there is a potential financial <br /> hardship should rent control come into place however, that does not alleviate him of his <br /> agreement to the Board prior to purchasing the park." "Mr. Haney objected to this <br /> rewording and requested to speak with the Board." <br /> Mr. Ball commented, "We could also add to it that if rental control does present a <br /> financial hardship Mr. Haney could bring it to the Board's attention for review," <br /> Mr. Cram relayed, "I think at this point to think that rent control is going to be a <br /> factor is more of a case of being a pessimist as opposed to being an optimist." "If rent <br /> control does become a factor then I as a member of Board are more than willing to <br /> reconsider, other then that no."
