MINUTES August 10, 1995 b BOARD OF IiEALTH
Mr. Perry stated, "They said there was nothing wrong with it, no charge and I
booked it back up." "Do an inspection on it tomorrow and tell me what you think.'
Mr. Doherty stated, "The two issues were the leaking pump which has been
looked at, repaired, removed and reinstalled." "The water service has been restored?"
Mr. Perry responded, "Yes."
Mr. Doherty stated, "The other issue is co-mingling, since there are no tenants
there it's not an emergency issue but none the less it needs to be addressed."
Mr. Perry stated, "Commonwealth Electric told me today, as long as both parties
agree to the electric terms, that there is no such thing as co-mingling." "A year ago when
they both moved in there, they did." "They were on housing and housing made sure it was
done properly." "The initial inspection was done by this office." "Those tenants there are
not the best people in the world."
Mr. Evans commented, "The Board of Health is used as a hatchet many times but
when there's a violation that's what we write down."
Mr. Perry questioned, "How can you issue a violation when you didn't even go to
the bottom of the stairs?"
Mr. Evans replied, "I saw the water and the tenant said that it had been that way
for a long time."
Mr. Perry commented, "That's because they don't want to pay last weeks rent."
"Of course she's going to tell you that."
Mr, Evans stated, "We try and stay out of tenant landlord disputes."
Mr. McQuaid stated, "I think we can resolve this amicably, without taking any
further steps and I don't know that you're request for a letter of apology is warranted
because if we really want to pursue the letter of the law here, you as the landlord are
required to provide and pay for water service." "If their water pump is on their electric
bill and your not paying for their water supply you, by law, have to provide an adequate
supply of hot and cold water." "Supply, provide and pay for."
.. (At this time Mr. Perry left. The tenants arrived later in the meeting at which time the
matter was again discussed.)
