MINUTES August 20, 1995 7 BOARD OF HEALTH
APPOINTMENT; Peter Durmer- 48 & #12 Sextant Circle
Mr, Peter Dunner, lot owner and Mr. Wesley Lohr from Wes Construction was in
attention for this scheduled appointment.
Mr. McQuaid relayed, "We approved this septic plan on June 14, 1995." "It has a
new Title V system proposed and there are no abutters on private wells." "There is one
abutter across from Sextant Circle, #7, whose well is more than 150' away from the
leaching facility." "Mr. Durmer called because his original well appears to be less then
100' from the proposed leaching facility however, Mr. Durmer hooked into town water
about one year ago." "His feeling is that he may at some future time want to reconnect his
private well as his source of drinking water which will then be less then the required
minimum distance of 100' away." "I explained to him that his well is now considered an
irrigation well and that in fact, he couldn't hook back-up to his old well and disconnect
from town water because of this septic system being approved as staked on site." "I
would further like to point out that according to the new Title V, the minimum distance
from an irrigation well to a septic tank is 10' and from an irrigation well to a Soil
absorption system is 25'." "He definitely has the 25' therefore, the issue of his irrigation
well prohibiting the installation of this leaching facility, in my opinion, is mute however,
since I could not convince the person of that suggested that he come before the Board."
Mr. Durmer stated, "It is going to very difficult to convince you gentlemen that I
don't have an irrigation well."
Mr. Cram questioned, "You hooked up to town water?"
Mr. Durmer replied, "That's correct." "I have never left my well as drinking
water." "I continue to use my well for drinking water and making cofJ'ee."
Mr. Cram questioned, "You have two separate feeds coming into the house which
is required by the Water District, it is not co-mingled?"'
Mr. Durmer responded, "That's correct."
Mr. Cram questioned, "Do you have two faucets in your kitchen?"
Mr. Durmer responded, "No sir, I tap the well from down at the well head." "I
bring my water upstairs just as if I buy it at the supermarket." "I've been drinking; water
out of the well for 16 years and been a resident of the town for about 21 years." "I
