"Subsequently, the engineer located my well and I <br /> assume there is a revised plan which is available." <br /> Mr. McQuaid informed Mr. Durmer, "According to the master plan your well <br /> should be 100' away from the proposed septic system." "The location we have on file for <br /> your lot delineates the well in another location." "We do not have the location of your <br /> well on proposed plans because irrigation wells do not have to be delineated." <br /> Mr. Doherty informed Mr. Durmer, "When somebody ties into town water that <br /> source of water is declared the potable drinking source of water." "It renders any wells on <br /> the property either condemned, abandoned or as irrigation wells." "For legality purposes <br /> we can only consider one source of water." `By tying into town water you've also <br /> consented that this is your drinking water." <br /> Mr. Durmer stated, "That's inaccurate." "No one represented that to me at the <br /> time." "The reason I hooked up to town water was due to the increase in fees if I didn't <br /> tie in initially." <br /> Mr. Doherty stated, "You're not in compliance with the master plan." "The <br /> proposed system was moved due to the availability of town water however, there is an <br /> alternative location to place the leaching facility." <br /> Mr, Ball questioned Mr. Lohr as to whether he would move the system towards <br /> the front of the lot. <br /> Mr. Lohr responded, "As long as there is no additional cost." <br /> Mr. Doherty commented, "I can't ask Mr. Lohr to spend more money to have the <br /> plan redrawn based on the fact that you have town water." "The Board considers that <br /> safe, potable, drinking water provided by the town barring that Town Counsel tells us that <br /> just by tying into town water you do not necessarily undeclare your well as your drinking <br /> source." "The Board of Health has the authority to declare what is acceptable and what is <br /> not." <br /> Mr. McQuaid stated, "I think the Board ought to consider the installation of <br /> irriga*.ion wells and new irrigation wells because if we allow irrigation wells to control the <br /> location of abutting septic systems then who's to say that someone doesn't come along <br />
