MINUTES October 8, 1998 5 BOARD OF HEALTH <br /> of the building permits on the condition no occupancy permits would be issued or signed- <br /> off on without the treatment plant being fully approved by the D.E.P.." "Apparently, it <br /> turned out Mr. Bonvie has been pressuring the building department for occupancies and <br /> that resulted in our meeting." "We're planning a meeting again tomorrow to deal with the <br /> building and fire departments because the building and fire departments have serious issues <br /> with occupancies out there_" "Our concern is the fact that the wastewater treatment plant <br /> is not on line and is not approved by the D.E.P. at this point." "It just so happened that <br /> the morning of our meeting, within minutes Mr. Bonvie called me and said that D.E.P. <br /> was going to be down yesterday to give final approval of the treatment plant." "He called <br /> me first thing this morning and said he had bonding problems and that the D.E.P. would <br /> not sign-off on the treatment plant until at the earliest next Wednesday so the meeting is <br /> scheduled next Wednesday at 10:00 a.m.." "We went through this six years ago." "We <br /> somehow were convinced he could use the holding tanks, put up a bond in case he had to <br /> pump the holding tanks until he had enough occupancies to get the treatment plant going." <br /> "In my opinion, it's no where near that, we should not grant occupancy permits until <br /> D.E.P. approves the treatment plant to be on line." "If the D.E.P. approves the plan to be <br /> 100% functional and issues a discharge permit they can still use the holding tanks until he <br /> gets enough occupancies to warrant the activation of the plant." "I want the D.E.P. to <br /> approve the plant as operational, then he can shut it down." <br /> Board members agreed no action shall be taken at this time. <br /> Transfer Station Schedule <br /> Mr. McQuaid relayed, "Part of Mr. DiMaggio's contract was that he be clos4,,gp_:: <br /> both Tuesdays and Thursdays from November through March." "There was distasion;;. <br /> last spring about changing the contract, putting in more money to leave the transfer stion., <br /> open on Tuesdays in the wintertime." "My last recollection in these discussions with Mr:. <br /> Whritenour was that if he could find the money would we stay open on Tuesdays and it <br /> was left like that." "Well, apparently he found the money to stay open on Tuesdays." <br /> "None of us acted upon it." "Now it's getting close to November I' and Mr. Whritenour <br /> is expecting us to stay open on Tuesdays through the winter." <br /> Mr. Cram commented, "This was a contract agreement with Mr. DiMaggio from <br /> two years ago." "In order for the contract to be revised there must be some sort of <br /> agreement between the contractor and the Board as far as whatever fee is going to be paid <br /> for that additional day for this extra period of time." <br /> i <br />
