MINUTES September 2, 1999 6 BOARD OF HEALTH <br /> Mr. McQuaid commented that he spoke to Brian Dudley this afternoon and he <br /> confirmed what Mr. Mitrokostas is saying: that the DEP is willing to recalculate the <br /> flow from the John's Pond Center where it is 35 gallons per seat per day and willing to <br /> reconsider it as a fast food operation based on the fact that it is all paper and plastic <br /> service rather than china and silverware; therefore, are willing to recalculate to 20 <br /> gallons per seat per day. However, Mr. Dudley said that they would not waiver on the <br /> actual size of the tank and the size of the grease trap. The tank being 8,000 gallons is <br /> the new calculation. Mr. McQuaid noted that the tank is under the old Title V that <br /> required 150% capacity; and, under this, the 8,000 gallon tank is adequate for 6,000 <br /> flow (150% of 6,000). However, the grease trap at the size of 2,000 would limit his <br /> total seating to 133 seats, where there is no variance. <br /> Mr. McQuaid suggested to the Board that Mr. Mitrokostas or they send a letter to DEP <br /> stating that they have reviewed the request of the applicant for the additional outdoor <br /> seating and it is the opinion of the Board of Health, given that they have a copy of the <br /> contract with a licensed septage hauler who will inspect the tank at the same time <br /> that they would inspect the grease trap and pump, as necessary. Given that <br /> guarantee, the size of the tank should be adequate, the size of the grease trap is <br /> adequate if inspected, and the size of the leach field is satisfactory; however, sometime <br /> in the future, will have to submit a plan showing the new reserve area for the leach <br /> field. <br /> Mr. McQuaid stated that the four variances are: <br /> • Going from 35 to 20 gallons per seat. <br /> • Allowing the continued use of the 8,000-gallon septic tank. <br /> • Allowing the continued use of the 2,000-grease trap based on monthly <br /> inspections by a licensed septic hauler. <br /> • Submittal of a new plan showing the reserve area. <br /> Mr. McQuaid commented that this should be sent to DEP and ask for their <br /> consideration concurring with the Board of Health's approval. <br /> Mr. Ball stated that he doesn't have a problem with it at all if they send it out to DEP <br /> and they approve it. . <br /> Mr. McQuaid noted that you have to get something in writing from DEP. <br /> Mr. Cram made a motion to grant the four variances as requested by Mr. Mitrokostas, <br /> conditional upon approval by DEP: <br /> • Now recognized as a fast food designation at 20 gallons/seat per day, reduced <br /> from the 35 gallons/seat per day. <br /> • Continued use of the 8,000-gallon tank with monitoring to be reported to the <br /> Board of Health. <br /> • Continued use of the 2,000-gallon grease trap with monitoring in the agreement <br /> and according to the contract from Warren Cesspool Service to do monthly <br /> inspections and pumping as necessary to be reported to the Board of Health. <br /> • The engineering plans submitted showing the new reserve area. <br /> i <br />
