 A portion of the projects falls under Natural Heritage jurisdiction. However, the response
letter indicates the presence of mollusk species in the area and determines that the
proposed project will have no impact on these water-dependent species.

COMMISSIONERS COMMENTS

 The commission addressed the issue of the deteriorating condition of the roadway and
inquired about the proposal's plans for regrading the road. The assistant agent explained
the difficulties associated with performing any work on the roadway. Currently, the state
owns the land, and the homeowners are in the process of requesting ownership rights.
The discussion continued, and a letter from the applicants' attorney, Ben Zender, was
entered into the record.
 The chair stated that the commission does not have the authority to approve beach
nourishment on property that the applicant does not own.
 The assistant agent suggested two potential options to the commission concerning the
issue at hand:
o The applicants must proceed through the land court process to obtain ownership.
 If the land court process is unsuccessful, written permission from the state must be
obtained and submitted to the Conservation Department before any work can commence.
 Several commissioners expressed concerns about the transfer of ownership and its
potential impact on public access. Various alternatives were discussed that would allow
the land ownership to remain the same as it is currently.

APPLICANT COMMENTS

Mr. and Mrs. Griffin assured the Commission that there is no intention to do anything to
the roadway beyond repairing it. They emphasized that the proposal is solely focused on the
beach area. Further discussion followed regarding the Commission's concern about the potential
transfer of ownership.

PUBLIC COMMENTS

Mr. Shay a resident on Ninigret Ave expresses his support for the beach nourishment
proposal and the lack of sand currently on the beach.

AGENT COMMENTS

 Proposed beach nourishment within existing beach areas above the mean annual high
water mark of Johns Pond.
 Pending Natural Heritage determination regarding rare species habitat.
14
