A portion of the projects falls under Natural Heritage jurisdiction. However, the response <br />letter indicates the presence of mollusk species in the area and determines that the <br />proposed project will have no impact on these water-dependent species. <br /> <br />COMMISSIONERS COMMENTS <br /> <br /> The commission addressed the issue of the deteriorating condition of the roadway and <br />inquired about the proposal's plans for regrading the road. The assistant agent explained <br />the difficulties associated with performing any work on the roadway. Currently, the state <br />owns the land, and the homeowners are in the process of requesting ownership rights. <br />The discussion continued, and a letter from the applicants' attorney, Ben Zender, was <br />entered into the record. <br /> The chair stated that the commission does not have the authority to approve beach <br />nourishment on property that the applicant does not own. <br /> The assistant agent suggested two potential options to the commission concerning the <br />issue at hand: <br />o The applicants must proceed through the land court process to obtain ownership. <br /> If the land court process is unsuccessful, written permission from the state must be <br />obtained and submitted to the Conservation Department before any work can commence. <br /> Several commissioners expressed concerns about the transfer of ownership and its <br />potential impact on public access. Various alternatives were discussed that would allow <br />the land ownership to remain the same as it is currently. <br /> <br />APPLICANT COMMENTS <br /> <br />Mr. and Mrs. Griffin assured the Commission that there is no intention to do anything to <br />the roadway beyond repairing it. They emphasized that the proposal is solely focused on the <br />beach area. Further discussion followed regarding the Commission's concern about the potential <br />transfer of ownership. <br /> <br />PUBLIC COMMENTS <br /> <br />Mr. Shay a resident on Ninigret Ave expresses his support for the beach nourishment <br />proposal and the lack of sand currently on the beach. <br /> <br />AGENT COMMENTS <br /> <br /> Proposed beach nourishment within existing beach areas above the mean annual high <br />water mark of Johns Pond. <br /> Pending Natural Heritage determination regarding rare species habitat. <br />14 <br /> <br /> <br />
