Total of 8 cubic yards of sand to be used for nourishment in two areas. <br /> No alteration of bank or vegetation. <br /> Land ownership issues currently in land court. <br /> Project conditions to ensure no adverse water quality impacts. <br /> All work to be done by hand with sand delivered by dump truck. <br /> <br /> Agent recommends: close and issue with the following conditions: <br />o No work to commence until land ownership is confirmed for all areas of <br />proposed beach nourishment. <br />o All pre-nourishment conditions from MA NHESP must be fully complied <br />with before work begins. <br /> <br />Motion made by Ms. Zollo to close and issue with the condition that no work can commence <br />until the State provides written approval or the ownership is changed, and the Commission <br />submits a letter requesting the Land Court to not relinquish to private ownership. Motion <br />seconded by Ms. Clapprood. *Clarification: the Commissions letter to Land Court is not a <br />condition of approval. * <br /> <br />Further Discussion: Additional conditions discussed and included in the motion: <br /> A copy of the Commission's letter will be sent to both the Senator and the State <br />Representative. <br /> Any conditions from Natural Heritage must be added to the order of conditions. <br /> <br />o ROLL CALL: Ms. Zollo (Yes), Mr. Clapprood (Yes), Ms. Godfrey (Yes), Ms. <br />Thornbrugh (Yes), Mr. Colombo (Yes). <br /> <br />The motion passes unanimously <br /> <br /> *The Commissioner letter will be drafted by Ms. Zollo and Ms. Clapprood.* <br /> <br />Documents provided: Baxter Nye Engineering, Inc., Notice of Intent application and <br />project narrative, 06/05/24 Plan “Beach Nourishment Plan” (sheet C1.0), 06/05/24 Plan <br />“Details & Beach Profile” (sheet C2.0) <br /> <br />6:42 <br />NOI 43-32__ (DEP # not issued) <br /> <br /> 642 Squaw’s Lane, Popponesset Beach Association.
