o Inquiry: Confirmation that the existing wall will remain and the new bulkhead <br />will be installed on the seaward side. <br />o Explanation: A vibratory hammer will drive the bulkhead at the toe of the existing <br />stones. The soil will be filled and seeded with supplemental plugs for vegetation. <br />Planting will extend behind the wall to stabilize the area. <br /> Wetland Delineation and Mitigation Plans <br />o Issue Raised by Commissioners: <br /> Existing wetland delineations may be inaccurate. <br /> Recommendations for hiring a wetland consultant to accurately reassess <br />and delineate wetland boundaries. <br />o Applicant’s Response: <br /> Open to hiring an external wetland consultant or utilizing their own <br />wetland scientist. <br /> The Agent proposed two options: <br />1. Conduct a wetland delineation to identify accurate boundaries for <br />appropriate mitigation <br />2. Expand the current mitigation plan to cover areas presumed to be <br />wetlands based on site observations. <br /> Additional Concerns <br />o The current construction appears to be misaligned with existing conditions. <br />o Need for integrated planning to visualize interactions between the pool, patio, <br />existing walls, and the new bulkhead. <br />o There is no waiver request for the vertical walls or setbacks. <br /> <br />Letter from the Division of Marine Fisheries <br /> Content: Concerns regarding adding a new vertical bulkhead in a designated wetland <br />area. <br /> Applicant Defense: <br />o Emphasized that local experts are more familiar with the site than the DMF. <br />o It stated that the bulkhead installation is considered maintenance to prevent <br />further environmental disruption. <br />o In addition, alternative methods (such as rebuilding the existing wall) would have <br />a more significant environmental impact. <br /> The Commission references the lack of a waiver request for vertical walls or setbacks. <br /> <br />There are no public comments. <br /> <br />Agent Comments <br /> The existing stone seawall and pier are licensed Ch. 91 structures (license # 13541). <br /> The proposed replacement bulkhead must be reviewed by Ch. 91 after the issuance of an <br />order of conditions. <br /> The Division of Marine Fisheries comments recommend rebuilding/repairing the existing <br />stone wall to avoid impacting marine habitat or possibly moving the existing stone wall <br />further landward to allow for salt marsh migration. If the existing wall were to be moved <br />landward, it would likely impact the bordering vegetated wetlands abutting the stone <br />wall. Rebuilding the existing wall would likely create similar short-term impacts on the <br />8 <br /> <br /> <br />
