marine environment as would the construction of a bulkhead seaward of the existing <br />stone wall. <br /> In researching a previously issued OOC (DEP file # 43-2971) for razing and replacing the <br />existing home, the required mitigation was never completed (total of 930 sq ft of <br />mitigation owed). <br /> Agent recommends: <br />o The mitigation plan should be revised to span the entirety of the flat area of <br />the lawn between the toe of the slope and the existing sea wall. This entire area of <br />lawn is likely comprised of hydric soils and thus expresses wetland conditions. <br />o The Commission can require the consultation of a wetland expert to delineate this <br />area at the applicant’s expense to define and delineate the extent of wetlands <br />clearly should it be necessary or, if agreeable with the property owner, the <br />mitigation can be expanded to cover this entire area of flat lawn adjacent to the <br />seawall. <br /> <br />Further Discussion <br /> Email correspondence between the representative and the Conservation Department is <br />read into the record. <br /> <br /> BOARD OF HEALTH: Note the location of the septic system and restrict equipment/ <br />vehicle traffic over non-load bearing (H-10) components. Access to septic components <br />must be maintained. <br /> <br /> BUILDING: No comment. <br /> <br /> SHELLFISH: This project will not warrant a Shellfish mitigation fee. <br /> <br />Mr. Cook makes a motion for the continuation to October 24, 2024, at 6:30 to allow time for the <br />applicant to work out a mitigation plan of 930 sqft, additional mitigation, and to show the pool <br />patio and walls on the plan so the commission can see against the proposed plan. Ms. Godfrey <br />seconded the motion.
