The lot’s wetland and stormwater management features are detailed, highlighting the
site’s compliance with local bylaws and performance standards.
Additional mitigation measures involve replanting and maintaining buffer zones with
native species
Utilities and nitrogen loading standards comply with local regulation
The plan meets architectural and neighborhood requirements for Willowbend
Need for precise construction plans, including retaining wall design and house
foundation.

Concerns and Requested Amendments:
Commissioners raised concerns about the feasibility of construction, particularly related
to the proximity of retaining and foundation walls to the work limit
Additional structural details and cross-section designs were requested to demonstrate
adherence to work limits

Legal Questions & Grandfathering Clause:
Questions raised about the grandfathering rights of a project approved in 2019, extended
recently to 2023.
Reference to COVID extension act; discussion about legal predictability and fairness for
homeowners regarding delineations
Suggestion to speak with Legal Counsel for opinion to address concerns about updated
buffer zones and regulations

Conservation & Wildlife Habitat Concerns:
Concerns about changes in conservation management boundaries due to ecological shifts
Mention of best practices in wildlife habitat management and the need for clear
boundaries and updated information on current habitat conditions
Demand for wildlife habitat assessment, specifically on the effects of ongoing
developments on local species

There are no public comments.

Agent Comments
The original OOC was issued for a building envelope with a requirement for submission
of an amended order request for house footprint/landscaping, etc. Subsequent amended
orders were granted for vista pruning and eradication of invasive phragmites. Extension
permits were filed to keep the original order valid through 11/24/2026.
Applicants assert that the previous 50/100 ft buffer zones are grandfathered for this
amended order request because the original order issued for the building envelope pre-
dated the buffer zone expansion (see letter from Atty Franklin as part of this AOC
request).
The proposed project scope is just outside the 50 ft setback to the top of the coastal bank.
No proposed alteration of the coastal bank.
Project locus is outside the 100-year floodplain but within the 100 (150) ft buffer zone
16
