3 Board of Selectmen Minutes September 10, 2007 Public Hearing (cont'd from April 9, 2007)—Finally Dino's: The Board of Selectmen opened the Public Hearing continued from April 9, 2007 on the annual liquor license renewal of Barnstable Pizza and Pasta Co., Inc. dlb/a Finally Dino's, Constantino's Mitrokostas, Manager to show cause why the Board should not suspend,revoke or cancel the annual alcohol restaurant license renewal application as it relates to the matter of the Massachusetts Fire Safety Act requiring automated sprinkler systems by the date of November 15, 2007. Correspondence was received from Dino Mitrokostas dated September 4, 2007 indicating that due to a prior commitment, Mr. Mitrokostas is unable to attend the September 10, 2007 public hearing. Mr. Mitrokostas indicated in his letter that he would provide a written report on the progress of the sprinkler installation. According to the correspondence as of September 3,2007,the sprinkler system has been installed in the required areas agreed upon by the Mashpee Fire Department. The system is also being"air checked"to ensure its integrity. The permit has been filed and been paid for to the Mashpee Water District to bring water to the system. The water line is in the building and will be tested. HTAS Alarms will be installing and monitoring the system alarm. Based upon the progress,Mr. Mitrokostas reported Finally Dino's should meet the November 15, 2007 deadline. Fire Chief George Baker was in attendance to review the subject matter with the Board of Selectmen. To date,the Fire Department has not conducted an inspection of the air test or hydrostatic (water)test, which is a noted responsibility of the contractor and not the owner to notify the Fire Department. In accordance with present state requirements, sprinklers shall be installed in the section of Finally Dino's and Dino's Sports Bar occupied and accessed by the public that includes the kitchen and hallways. The critical date is the November 15, 2007 deadline for code compliance, a life safety requirement for the patrons and licensed entertainment area. For the record, Chief Baker stated that this type of sprinkling is dangerous because it doesn't fully protect the building. Motion made by Selectman Taylor to continue the Public Hearing of Finally Dino's to Monday,September 24,2007 at 6:40 p.m. Motion seconded by Selectman Green. VOTE: Unanimous. 5-0.
