3 <br /> Board of Selectmen <br /> Minutes <br /> September 10, 2007 <br /> Public Hearing (cont'd from April 9, 2007)—Finally Dino's: <br /> The Board of Selectmen opened the Public Hearing continued from April <br /> 9, 2007 on the annual liquor license renewal of Barnstable Pizza and Pasta <br /> Co., Inc. dlb/a Finally Dino's, Constantino's Mitrokostas, Manager to <br /> show cause why the Board should not suspend,revoke or cancel the <br /> annual alcohol restaurant license renewal application as it relates to the <br /> matter of the Massachusetts Fire Safety Act requiring automated sprinkler <br /> systems by the date of November 15, 2007. <br /> Correspondence was received from Dino Mitrokostas dated September 4, <br /> 2007 indicating that due to a prior commitment, Mr. Mitrokostas is unable <br /> to attend the September 10, 2007 public hearing. <br /> Mr. Mitrokostas indicated in his letter that he would provide a written <br /> report on the progress of the sprinkler installation. According to the <br /> correspondence as of September 3,2007,the sprinkler system has been <br /> installed in the required areas agreed upon by the Mashpee Fire <br /> Department. The system is also being"air checked"to ensure its integrity. <br /> The permit has been filed and been paid for to the Mashpee Water District <br /> to bring water to the system. The water line is in the building and will be <br /> tested. HTAS Alarms will be installing and monitoring the system alarm. <br /> Based upon the progress,Mr. Mitrokostas reported Finally Dino's should <br /> meet the November 15, 2007 deadline. <br /> Fire Chief George Baker was in attendance to review the subject matter <br /> with the Board of Selectmen. To date,the Fire Department has not <br /> conducted an inspection of the air test or hydrostatic (water)test, which is <br /> a noted responsibility of the contractor and not the owner to notify the Fire <br /> Department. <br /> In accordance with present state requirements, sprinklers shall be installed <br /> in the section of Finally Dino's and Dino's Sports Bar occupied and <br /> accessed by the public that includes the kitchen and hallways. The critical <br /> date is the November 15, 2007 deadline for code compliance, a life safety <br /> requirement for the patrons and licensed entertainment area. For the <br /> record, Chief Baker stated that this type of sprinkling is dangerous because <br /> it doesn't fully protect the building. <br /> Motion made by Selectman Taylor to continue the Public Hearing of <br /> Finally Dino's to Monday,September 24,2007 at 6:40 p.m. <br /> Motion seconded by Selectman Green. <br /> VOTE: Unanimous. 5-0. <br />
