MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 12, 2025 <br /> Sitting on this hearing are the three regular Board members, Mr. Caggiano and Mr. <br /> Milbury. <br /> Attorney Christopher Kirrane represented the homeowners requesting a <br /> modification as indicated in the petition. The Board approved and issued a Special <br /> Permit in 2024 for the raze and replace of the existing dwelling. <br /> The modifications to the plan will not be creating any new nonconformities, or <br /> intensifying any existing nonconformities. The house will be moved a half a foot <br /> forward, but is still more than 25 ft. from the front yard setback and is still <br /> conforming. There will be a slight increase in the lot coverage from 21.5% to 24.5% <br /> and is still conforming to the Popponesset Overlay District. There is a height increase <br /> of 2 ft., from 27'.6.5" to 29'. 6.5" and is still under the 30 ft. requirement. There is <br /> also a small design change request to move the front entry to the middle of the <br /> house. <br /> Mr. Reidy read the Conservation Department comments into the record, and the <br /> Board of Health comments into the record. <br /> There were no abutters present. <br /> Mr. Morris mentioned that there's a height increase of the house, and crawl space. <br /> He requested that a non-conversion agreement be signed and on file with the <br /> Building Dept. It does not need to be registered with the Barnstable Registry. Also, <br /> because of the height increase of the house, he requested a stamped letter be <br /> submitted by a structural engineer at the time of submittal of the building permit. <br /> Mr. Morris explained to the Board that a non-conversion letter refers to any crawl <br /> space over 5 ft. will not be used as habitable space. <br /> Attorney Kirrane said he had a conversation with Mr. Morris, and his client agreed <br /> to sign a non-conversion agreement and will not use the crawl space as habitable <br /> space. <br /> The Board had questions regarding the plan. Attorney Kirrane provided a revised <br /> site plan that depicted what the Board had approved, but also had the recent <br /> modifications. <br /> Mr. Morris mentioned that abutters did receive notification letters. <br /> There were no more comments from the Board or audience. <br /> Mr. Reidy made a motion to close public comment. Ms. Sangeleer, so moved. Mr. <br /> Blaisdell, second. All were in favor. <br /> 7 <br />
