The Board has determined that the applicant meets all the conditions of a <br /> Modification to the Special Permit under Mass General Law 40A Section 9. <br /> 2. Conditioned on all Town Department comments read into the record including <br /> but not limited to the Board of Health and Conservation Department comments. <br /> 4. Condition on submission that a letter of non-conversion that the crawl space <br /> will not be utilized for habitable purposes. <br /> 5. Any changes to the plans will require the applicant to return to this Board. <br /> 6. The Board finds that the Modification to the existing Special Permit SP-2024- <br /> 26 under §174-17.1, §174-33, and 174-24 (C) (9) (b) as submitted is not <br /> substantially more detrimental to the neighborhood. <br /> Mr. Furbush second, yes, <br /> Mr. Caggiano, yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Milbury, yes, <br /> Ms. Sangeleer, yes <br /> All were in favor to issue a Modification. <br /> 68 Mercantile Way: Owner, Osterville Back Bays, LLC is seeking a Modification of <br /> an existing Special Permit (SP-2022-29), Condition 46 under §174-24 (C) (9) (b) and <br /> (c) of the Zoning Bylaws to allow the already planted trees to be spaced approximately <br /> 10' - 12' apart; add four (4) additional trees spaced 12' apart; add a concreate pad <br /> with 6' stockade fence for dumpster; and add eight (8) additional parking spaces on <br /> property located in an I1 Zoning District, Map 88, Parcel 91, Mashpee, MA. <br /> Attorney Christopher Kirrane presented the modification request as indicated in the <br /> petition. The Board issued and approved a Special Permit for this project back in <br /> 2022. His client agreed to a condition, but did not have to agree to install (11) eleven <br /> additional trees, 8 ft. apart. These trees were installed 10-12 ft. apart and are <br /> sizeable trees. There are no requirements in the zoning bylaws that indicate that <br /> any trees are required to be installed. <br /> A <br />
