12
Board of Selectmen
Minutes
October 30, 2000
OLD BUSINESS:
Discussion of Use of Legal Resources: (continued)
The discussion relative to possible representation was discussed with
Perkins and Cole. Their specialty lies in Washington. Perkins and Cole
indicated that they would remit a package to the Selectmen of their intent
on this matter. If appointed to the position, it would be their intent to
work with additional counsel.
It was noted that the law firm of Hale and Dorr has been traditionally used
for these circumstances. It may not be prudent to turn matters over to new
lawyers whose learning curve would be way behind that of Hale and Dorr
noted Selectman Leveille who suggested the Board continue to pursue
another law firm or at least a lead law firm on this matter. Additional
counsel could be utilized for back-up purposes.
Selectman Green suggested that Town Counsel be consulted with regards
to obtaining a legal ruling on the legality options to determine where the
towns stands on this matter, and if this action should be taken. Selectman
Green indicated that he is against members of the public taking public
funds and using them against an administration process.
Selectman Taylor agreed that Town Counsel, Kopelman and Paige should
be consulted with regards to the present status of the town. Selectman
Leveille added that there is no intent to use the funds against anybody.
Selectman Marsters: ...The way I look at it, we have had Hale and Dorr
since day one. We keep them in, and if we need Perkins and Cole, we ask
them. Selectman Leveille: I agree with that totally.
Selectman Green: ...Hale and Dorr...well, the fact is if we go in there,
we'd close the door when we sit down and make discussions...
Selectman Leveille: Yes, that is very unfortunate, but we have to make
decisions on this based on the entire town and what is available to us...
