5 <br /> Board of Selectmen <br /> Minutes <br /> September 13, 1999 <br /> APPOINTMENTS AND HEARINGS: <br /> Attorney Stephen Olesky: <br /> The Board of Selectmen met with Attorney Stephen Olesky of Hale and <br /> Dorr to advise them on the process of the Wampanoag Indian Tribal <br /> Council's plans for federal recognition. <br /> Hale and Dorf were hired by the Town as special counsel to assist in <br /> discussions about the nature and extent of the recognition being sought. If <br /> federal recognition status is granted there is a potential for land use <br /> controls such as gambling activities and possible claims to revive Indian <br /> Tribal lands. <br /> It is prudent for the Town to have a voice in the recognition informed <br /> Attorney Olesky. The Selectmen agreed to meet with the Tribal Counsel <br /> next week to review their objectives and discuss the process and their <br /> involvement with their bid for recognition. <br /> A <br /> ggrney Robert Mills--Golf Course Land Pro sal: <br /> Attorney Robert Mills of Wynn and Wynn was present with the Cape Club <br /> developers to discuss properties located in of Santuit Park. It was noted <br /> that an article appears on the Town Meeting warrant proposing to give the <br /> Selectmen authority to deed out the Town's interest in the listed parcels, <br /> all of which were taken at various times for non-payment of taxes, <br /> although a number are incorrectly assessed to other parties. <br /> Title research for other property owners in the area indicates that the Town <br /> may have only a half interest in the parcels and that the land, which is in <br /> scattered pieces in a"paper" subdivision east of Santuit Pond,is also <br /> subject to sanding rights in favor of adjacent cranberry bog owners. <br /> In addition,there appear to be two private residences located on some of <br /> the parcels which,although apparently taken by the Town more than 30 <br /> years ago, have continued to be assessed to the home owners,who have <br /> continued to pay taxes on the properties. <br />
