1 <br /> I <br /> Board of Selectmen <br /> Minutes <br /> April6, t998 4 <br /> ** Selectmen Caffyn made a motion to close the public hearing. Selectmen Marsters <br /> seconded the motion. All members in favor 3-0** <br /> Selectmen Caffyn noted there were parts of the application not completed. The applicant should <br /> complete the application before returning before the Board. <br /> **Selectmen Caffyn made a motion to continue the public hearing to April 27'tr Selectmen <br /> Marsters seconded the motion. All members were in favor 3-0** <br /> APP INTMENTS AND HEARINGS <br /> T25 Aquaculture License public Hearings. 5 separate hearings scheduled. They will be taken 1 at <br /> a time. <br /> Shellfish Constable Rick York gave a brief overview of the permit requests. He presented a map <br /> locating all the proposed grants. He explained when he was hired 6 years ago the intent was to <br /> re build the shellfishery. This has been successful with quahogs but not yet with oysters. The best <br /> way to get oysters back is to put them in key locations and hope they will throw off enough spat <br /> so that the oyster fishery can be opened again. <br /> 1. Steve Bali: was present. He lives at Amy Brown Road, his property comes out to the proposed <br /> grant area. His proposal has been reviewed by the Shellfish Commission, Waterway <br /> Commission and the Tribal Council. He has addressed all of the Harbormaster's concerns. The <br /> license request is for 10 years. <br /> Rich York explained the term of the license is up to the Board of Selectmen. The State statue <br /> allows for up to 10 years. <br /> Selectmen Marsters asked if there is any performance clauses in the license, in case the applicant <br /> doesn't work the grant after a few year? <br /> Rich York said the State removed their performance clause. The Shellfish Commission and <br /> Waterways Commission have worked on performance clause for the past few months and will <br /> have a final draft ready for the Selectmen by next month. <br /> Selectmen Marsters suggested approving these grants subject to the performance clause. <br /> Rich York said if the Selectmen approve these tonight, they go to Conservation Commission and <br /> Div. Of Marine Fisheries for approval. Tonight is the first step and the performance criteria will <br /> be ready before those next two reviews. <br /> Harbormaster has approved all the sites to navigation. <br /> Rick York, Shellfish Constable recommends all the requests. <br /> Public Comment: <br /> i <br /> A member of the Board of Directors of the Tribal Council said the Ball and Cassanelli requests <br /> are not in productive shellfish areas. However, the proposals in the boat slip area are in <br /> productive areas. He does not think DMF will approve those 2 sites (Sampson, Leveille). He has <br /> no problem with the grants in areas that have no productive shellfish. <br />
