Y BOARD OF SELECTMEN Page 3 MINUTES TUESDAY, SEPTEMBER 4, 1990 - REGULAR SESSION Article #4.: Selectman Lawrence made the motion that article #4 not be included in the warrant. Chairman Carter seconded the motion. The three remaining Selectmen oppose 'the motion. Selectman Gottlieb made the motion to include Article #4 in the warrant. Selectman Jacobson seconded the motion. The Selectmen vote in favor of the article. 3-2. Article #j Selectman Lawrence feels the taxpayer, homeowner and dock-owner should not be put under the constraints of this article. Michael Makunas of the Board of Appeals and Shellfish Constable and the Harbormaster feel this is a good approach to solve a difficult problem. They feel the only good time to judge the mooring or boat traffic is to go out and view in season. Mr. Reardon doesn' t approve of this. He feels this is an improper excise of the bylaw to restrict an applicant to appeal. Selectman Jacobson commends the Committees for their intentions: She questions the time constraints of the applications. Mr. Makunas . stated by changing the rules, it is possible the application won' t be granted without prejudice. The motion was made by Selectman Lawrence to remove Article #5 from the warrant. Selectman Hanson seconded the motion. The vote of the Board is unanimous. Article #12: 'Selectman Gottlieb is concerned with the way this article is written. He would . like to adopt a directive prior to Tows Meeting. The ammendments were made to include the use of the mooring for the designated. purpose for two consecutive years, the Harbormaster may revoke or decline to renew the mooring permit. - The motion was made by Selectman Gottlieb to include Article #12 with ammendments. . Selectman Hanson seconded the motion. The vote of the Board is unanimous. Article #14: The purpose of this article states Selectman Jacobson is to have a bylaw for the police to act upon and enforce. The police will be able to issue a warning and a citation for tress- passing. The intent is for during the day Lusage. A time frame should be included of the hours to be enforced. Selectman Gottlieb agrees it has some merit and needs to be refined. The motion was made by Selectman Gottlieb to ammend the article to include the hours of constraint. Selectman Jacobson seconded the motion. The vote of the Board is unanimous. Article #16: Selectman Gottlieb made the motion to include Article #16 in the warrant with the word further deleted.
