Y <br /> BOARD OF SELECTMEN Page 3 <br /> MINUTES <br /> TUESDAY, SEPTEMBER 4, 1990 - REGULAR SESSION <br /> Article #4.: Selectman Lawrence made the motion that article #4 <br /> not be included in the warrant. Chairman Carter seconded the motion. <br /> The three remaining Selectmen oppose 'the motion. <br /> Selectman Gottlieb made the motion to include Article #4 in <br /> the warrant. Selectman Jacobson seconded the motion. The Selectmen <br /> vote in favor of the article. 3-2. <br /> Article #j Selectman Lawrence feels the taxpayer, homeowner <br /> and dock-owner should not be put under the constraints of this article. <br /> Michael Makunas of the Board of Appeals and Shellfish Constable <br /> and the Harbormaster feel this is a good approach to solve a difficult <br /> problem. They feel the only good time to judge the mooring or boat <br /> traffic is to go out and view in season. <br /> Mr. Reardon doesn' t approve of this. He feels this is an improper <br /> excise of the bylaw to restrict an applicant to appeal. <br /> Selectman Jacobson commends the Committees for their intentions: <br /> She questions the time constraints of the applications. <br /> Mr. Makunas . stated by changing the rules, it is possible the <br /> application won' t be granted without prejudice. <br /> The motion was made by Selectman Lawrence to remove Article #5 <br /> from the warrant. Selectman Hanson seconded the motion. The vote <br /> of the Board is unanimous. <br /> Article #12: 'Selectman Gottlieb is concerned with the way this <br /> article is written. He would . like to adopt a directive prior to <br /> Tows Meeting. <br /> The ammendments were made to include the use of the mooring for <br /> the designated. purpose for two consecutive years, the Harbormaster <br /> may revoke or decline to renew the mooring permit. - <br /> The motion was made by Selectman Gottlieb to include Article #12 <br /> with ammendments. . Selectman Hanson seconded the motion. The vote <br /> of the Board is unanimous. <br /> Article #14: The purpose of this article states Selectman <br /> Jacobson is to have a bylaw for the police to act upon and enforce. <br /> The police will be able to issue a warning and a citation for tress- <br /> passing. The intent is for during the day Lusage. A time frame should <br /> be included of the hours to be enforced. <br /> Selectman Gottlieb agrees it has some merit and needs to be <br /> refined. <br /> The motion was made by Selectman Gottlieb to ammend the article <br /> to include the hours of constraint. Selectman Jacobson seconded the <br /> motion. The vote of the Board is unanimous. <br /> Article #16: Selectman Gottlieb made the motion to include <br /> Article #16 in the warrant with the word further deleted. Selectman <br /> Jacobson seconded the motion. The vote is unanimous. <br /> I . <br />
