BOARD OE SELECTMEN page 3 MINUTES MONDAY, .NOVEMBER 19, 1990 South 'Ca e Beach Advisor Committee DEM: Mr. . Cullinan has stated the commitment to the road. by DEM and monies dedicated to the project will be recommended if land is to remain without an exchange. DEM would like to have one agreement as to how both issues will be dealt with. The road and the beach projects are subject to legislative act. If the agreement is not signed prior to the changes in administration, it is hard .to determine the effect. Dick Kendall assures that this is one of the highest priority projects with DEM. Selectman Hanson feels the worst scenario to happen would be funding complications in January with the new administration. What- ever action the Board takes would -be remiss if the community is not allowed to decide. The motion was made by Selectman Gottlieb to hold a Special Town Meeting on Monday, December 17, 1990 for the sole purpose of deciding on the disposition of an article to direct the Board of Selectmen to accept the design of South Cape Beach and reconstruction. of Great Oak Road at it presently exists in terms as discussed with the Board, South Cape Beach Advisory Committee and DEM. Mr. Kirsner is in favor of the motion to let the pe.ople decide and resolve the issue. He also does not want to lose sight of Great Oak Road and it' s reconstruction. Mr. Kendall has expressed DEM' s interest to attend the Special Town Meeting. He feels it is appropriate for the town to make the decision. Selectman Lawrence is opposed to the motion. He is opposed to the road and beach being linked together. The issues were separated and now we are linking them for one commitment. Selectman Carter has ammended the motion to have the Special Town Meeting for the sole purpose of the beach issue and' vote on the road issue tonight. Selectman Lawrence seconded the motion.. The vote of the Board is unanimous for the ammended motion. Also recommended by Town Counsel to indicate at Town Meeting to include the authority of the Board of Selectmen in the language to direct the Board to execute the agreement of the beach. The vote is unanimous with the Board. The motion was made by Selectman Gottlieb for the .Board to agree pending the resolution of the beach location and construction to Execute an agreement which included the reconstruction of Great Oak Road and transfer of funds as negotiated by Town Counsel, South Cape Beach Advisory Chairman Kirsner and representatives with DEM. Selectman Gottlieb ammended his motion to state the Board' s acceptance of DEM' s proposal to reconstruct Great Oak Road and accept the transfer of $620, 000to complete the task upon approval of Town Counsel and the South Cape Beach Advisory Chairman. Selectman Lawrence seconded the motion. The Board votes in a unanimous decision to accept the reconstruction of Great Oak Road,
