Mr. Dravis clarified that in the event the proposed project to build 48- <br /> Townhouses is approved, he would prefer gravel for the unfinished portion of Simons <br /> Road,provided however than a mutually satisfactory agreement is reached regarding <br /> maintenance. <br /> At this point Attorney McElhinney agreed to provide the Planning Department <br /> with a full set of revised plans for Staff/Board review. <br /> There being no further Board, Staff, or Public comment the Chairman entertained <br /> a motion for continuance. <br /> MOTION; Dennis Balzarini made a Motion to continue the Public Hearing in <br /> this matter to February 14, 2009 at 7:10 p.m.; which Motion was duly seconded by <br /> Joseph Mullin and so voted unanimously. <br /> Special Permit <br /> Stratford Ponds Condominium-Stratford Ponds Road <br /> Special Permit Site Plan Modification <br /> Sewer Lines/Relocated Wastewater Discharge Area <br /> The Chairman called this matter to order and recognized Attorney John Schaeffer, <br /> representing the Applicant. <br /> Attorney Schaeffer reminded the Board that the Applicant appeared before them <br /> in 2006 to request approval of modification to the Special Permit originally issued for <br /> 150 residential condominium units. The modification was for a change in the on site <br /> wastewater treatment plant. Applicant is proposing to move the leaching facility where <br /> the affluent is leached back into the groundwater from a water supply protection district, <br /> Zone II,into a less environmentally sensitive area; which change is fully supported by <br /> DEP. <br /> The relocation area however is located within designated open space as identified <br /> under the original Special Permit. The Special Permit modification was approved by the <br /> Board in November 2006, followed by DEP approval of the design plans. One of the <br /> Special Permit Conditions is approval of the final design and to determine that it does not <br /> require a further major modification of the Special Permit; and verification of <br /> construction details being sufficient for inspection and conform to good engineering <br /> practices. <br /> Steve Silver, Coler& Colantonio, addressed the Board on behalf of the Applicant <br /> in order to review the plans and explain construction of the wastewater system. He had <br /> some issues with the original plan, which has been modified,regarding consistency with <br /> DEP approval. He explained the wastewater system, noting that the wetland line shown <br /> on a previous plan had never been surveyed on the ground. When the land was surveyed <br /> he discovered that the wetland line did not appear on the plan. He made reference to the <br /> previously approved leaching field within the 100-ft. offsets to the wetlands, as well as <br /> 6 <br />
