Planning Board Meeting <br /> Minutes-of June 5, 1985 P e 4 <br /> Bonita Trust, cont. <br /> Mr. Nye stated that it is an Approval Not Required. Richardson Jonas said that he would <br /> like to see the line off the plan if they plan to combine the lots. Mr. Nye said that <br /> they have to draw deeds. Chairman Dubin said that if there is a notation on the plan that <br /> it is one lot for building purposes, it would suffice. <br /> With reference to lot 3, Mr.. Rowley made reference to the zoning by-law stating that no <br /> building should be erected except for a lot fronting on a street and not more than one <br /> principal building in a residential lot. <br /> Chairman Dubin commented that the Building Inspector would have to make the determination <br /> as to whether River Road meets the criteria if someone were to come in for a house on lot 3. <br /> Mr. Rowley commented that it would also be the Planning Board's decision to make in terms <br /> of endorsing the plan. Chairman Dubin said that a notation could be made on the plan that <br /> no approval is meant as to the status of River Road. <br /> —Mr. ye-w1Udrew lie' plan a Board as tl_ed—the sebretary to sc e u e him on the une _ _ .. <br /> agenda. Note: Mr. Nye took back the check. <br /> Elise M.Otis Property - Preliminary <br /> Mr. Nye stated that they submitted a preliminary plan awhile back which was reviewed by the <br /> Board. It was asked that they eliminate the loop where the lots were on two side and that <br /> they have open space and get rid the the road going through the lot. <br /> The Board asked the Town Engineer to review the changes and that it be scheduled for June 19. <br /> Perimeter Survey -Leo &Yvette Gregoire <br /> Parcel of Land - Old Mill Rd. & Quinniquisset <br /> Chairman Dubin commented that in 1973, there was a perimeter survey done of the two lots. <br /> They were both old cranberry land which passed through several peoples hands. The Plann- <br /> ing Board added a notation on the plan that parcel B is to be combined with the land of <br /> Alan Ryder and is not to be considered as a building lot by itself. <br /> Mrs. Gregoire said that during the Indian suit, the land was redeeded back to Ryder and <br /> Walker. <br /> Chairman Dubin told the Board that a building permit was issued for parcel B and the Gregoir.e 's <br /> have a house going up. Richardson Jonas asked how that happened? Chairman Dubin said that <br /> evidentally the Building Inspector made a determination that the access was suitable. Review <br /> of the access was made by the Board. <br /> Chairman Dubin raised the question as to why the notation was made on the plan. Mr. Rowley <br /> said that if it did not meet the requirements of Approval Not Required, then there would <br /> have to be some sort of notation. Mrs. Gregoire said that she had spoken to Mr. Walker and <br /> that he indicated that because Ryder was selling to one person and Walker was selling to the <br /> same person, the Planning Board wanted it to be one parcel and that was why the notation. <br /> Mr. Rowley asked what the problem was at this point? Chairman Dubin said that the problem <br /> is conveyancing and that the lawyer wants the note released from the Planning Board. <br /> Mr. Rowley suggested that they prepare a new plan to be put on record and show the access. <br /> He said that if the Board could determine that the access was suitable for the purpose of <br /> which was being used, then they could sign an Approval Not Required. The Board members <br /> agreed that Mr. Rowley's suggestion sounded like the safest way to go. Chairman Dubin asked <br /> that they show the cranberry bogs on the plan. <br />
