Attorney Mills made reference to Plan entitled, "Proposed <br /> Site Plan, Mashpee, MA, Prepared for M/3 151 Realty Trust, dated <br /> March 25, 1998" indicating the following: Five point five (5.5%) <br /> percent lot coverage; approximate building height twenty-three <br /> (23 ft. ) feet; with setbacks of eighty-two (82 ft. ) feet from the <br /> road layout. <br /> Attorney Mills informed the Board Applicant has obtained a <br /> variance from the Board of Appeals to park within the fifty (50 <br /> ft. ) foot buffer; and he is seeking approval to park within the <br /> seventy-five (75 ft. ) foot setback from the Planning Board. <br /> Attorney Mills noted the number of parking spaces proposed <br /> on the Plan to be thirty-nine (39) , designations for catch <br /> basins, contours being in conformance with zoning Bylaw <br /> requirements, and approved curb cut . <br /> Attorney Mills also brought to the Board' s attention, a <br /> request from abutters, Mr. and Mrs . Labute for some type of <br /> fencing and that this request be conditioned within the Special <br /> Permit. <br /> The Chairman expressed concerns regarding the issues of <br /> parking within the buffer zone and access, Right in-Right out. <br /> Mr. Ferragamo addressed these concerns be stating that a <br /> substantial portion of Applicant ' s lot is encumbered by an <br /> isolated land subject to flooding, which the Town of Mashpee <br /> drains its road runoff into. Due to Conservation Commission <br /> concerns and regulations governing construction near isolated <br /> land subject to flooding, there is very little room left in which <br /> to park cars. Applicant is seeking to build approximately four <br /> thousand (4, 000 sq. ft. ) square feet of space and in doing so has <br /> satisfied Conservation Commission requirements. <br /> Dennis Balzarini raised concerns regarding the proposed <br /> entrance, to which Mr. Ferragamo referred to the Plan indicating <br /> the intersection and stating the location was as close as <br /> possible to the isolated land as the Conservation Commission <br /> would allow. <br /> Chance Reichel expressed concern for the access/egress to <br /> the back road/Dunkin Donuts establishment and gaining access to <br /> the proposed parking area. Attorney Mills indicated sufficient <br /> space for three (3) lanes. References were being made to the <br /> Plan at this point, and there was discussion regarding traffic <br /> concerns and impacts. <br /> James Dorgan suggested signing (Do Not Enter) be required. <br /> Mr. Mitrokostas agreed that signage would be provided. Mr. <br /> Dorgan stated the signage issue should be indicated on the Plan. <br /> At this point, the Chairman read from letter addressed to <br /> -8- <br />
