formerly owned by Angelo Rosso, located on Simons Narrows Road. <br /> Mr. Murphy explained the subdivision has, for the most part, been <br /> built-out but for whatever reason, there is no Release on record <br /> for any of the lots. <br /> By way of explanation, the Town Planner stated this was an <br /> ANR Lot (#5) with a Covenant. He stated Simons Narrows Road was <br /> a dirt road at the time, and was being used by the Developer. <br /> The Town Planner also stated his opinion that the Covenant should <br /> be released as the road has been built and there are existing <br /> houses along it. <br /> Chance Reichel reminded the Board that the question raised <br /> at the May 20, 1998, Meeting was determination of release of Lot <br /> 5, "and all remaining lots' . <br /> The Chairman made the determination that although the Agenda <br /> reads, "Release of Lot 5 and all remaining lots from Covenant <br /> dated September 6, 1984", that the Release document before the <br /> Board reads, "Release of Lot 511 . <br /> The Chairman then entertained a motion be made regarding <br /> said request of Release of Lot 5 in the matter. <br /> MOTION: Chance Reichel made a Motion to approve request for <br /> Release of Lot 5, Simons Narrows Road, as shown on Plan dated <br /> September 6, 1984; which Motion was seconded by James Dorgan and <br /> so voted unanimously. <br /> Said Release of Covenant having been signed by Board Members <br /> and notarized by the Board Secretary. (This matter concluded at <br /> 7:40 p.m. ) <br /> Public Hearing <br /> M/3 151 Trust-Dino Mitrokostas, Trustee <br /> Application of Special Permit-Expansion of Johns Pond Center <br /> The appointed hour having arrived, the Chairman called the <br /> 7: 30 p.m. Public Hearing to order and recognized Attorney Mills, <br /> who introduced himself for the Record as Robert Mills, <br /> representing the M/3 151 Realty Trust . <br /> Attorney Mills introduced Samantha Woods from Horsley & <br /> Witten, who prepared the hydrogeological evaluation for the Water <br /> Quality Report; Anthony Ferragamo, Architect; and Applicant, Dino <br /> Mitrokostas. <br /> Attorney Mills stated Applicant was before the Board seeking <br /> a Special Permit to construct a building approximately four <br /> thousand (4, 000 sq. €t. ) square feet in a C-2 Zoning District and <br /> cited Section 174-45 .1 A through H. He stated the Lot to be in <br /> excess of two (2) acres, and that Town Counsel has determined <br /> this project to be a Commercial Center. <br /> -7- <br />
