The Chairman then asked Mr. Druley about the Town Meeting <br /> Eminent Domain action, to which Mr. Druley clarified it was for <br /> the entire six (6) lot parcel. <br /> The Chairman also determined that the Board had been unable <br /> to act on the Definitive request due to an incomplete filing and <br /> minor comments from the Consulting Engineer. <br /> (There was some discussion regarding the calculation used, <br /> three bedroom home-three person per dwelling. Mr. Dorgan stated <br /> he felt the number used was unrealistic. ) <br /> The Chairman inquired of the status of the Board of Health <br /> report. The Town Planner stated he has not seen the report. Mr. <br /> Druley stated he has made the filing with Board of Health. (It <br /> was noted the Application for Approval had been filed on April <br /> 1st. ) <br /> At this point, the Town Planner commented on the Water <br /> Quality Report, noting specific questions outlined in the <br /> Bylaw which have not been properly addressed and suggested that <br /> perhaps the Board would be able to accept a verbal response. <br /> The Town Planner inquired as to hazardous materials; a <br /> phosphorus calculation; and impacts on Abigail ' s Brook. <br /> Mr. Kerfoot responded to the issue of hazardous materials by <br /> stating the project is a residential subdivision and that no <br /> hazardous materials are expected to be involved. <br /> With reference to the phosphorous calculation, Mr. Kerfoot <br /> stated that technically this issue should have been addressed, <br /> but that there is no receiving water on which phosphorous <br /> calculations would be valid as there is no fresh water pond in <br /> the area where groundwater would flow to. <br /> With reference to the matter of Abigail ' s Brook, Mr. Kerfoot <br /> did acknowledge this to be a fresh water body, as well as a <br /> stream situation. He did offer to forward a follow-up letter to <br /> the Board. <br /> Mr. Kerfoot stated there are two (2) lots within the <br /> subdivision in which the flow would go into the brook area, <br /> and is drained into major wetlands area that are protected by <br /> the Town. He further stated the likelihood of this situation <br /> having any accumulative major impact would be very little. He <br /> did acknowledge that the Town Planners point was well taken, <br /> that the lot areas are within one hundred (100 ft. ) feet of the <br /> stream. <br /> The Chairman deferred to the Town Planner who clarified the <br /> Bylaw requires a report on impacts of any water bodies and that <br /> technically the Report is incomplete, unless the Board chooses to <br /> -5- <br />
