Minutes of Meeting <br /> Plan Review Committee <br /> Tuesday, January 7, 2025 <br /> Mashpee Town Hall Waquoit Meeting Room <br /> Mr. Collins mentioned that he has had discussions with Mr. Kiley and appreciates all the work <br /> at the Boys and Girls Club and is a great program. He directed the question to Mr. Bonvie <br /> asking if this proposal is on the same footprint that was approved at Town Meeting. He said <br /> if the answer is "no", then there just spinning wheels at this meeting. <br /> Mr. Bonvie asked what document was submitted at Town Meeting. Mr. Bonvie reviewed the <br /> document and wanted to know where the plan came from. He said Mr. Buckley's team <br /> performed a survey to capsulate whatever land was available to a closing boundary and <br /> distances, etc. The dotted line plan that Mr. Collins provided could not be exact where it <br /> depicts dotted lines. Mr. Bonvie said Mr. Buckley did a professional onsite survey to the exact <br /> location. Mr. Buckley looked at the dotted line plan and could not determine what it specified. <br /> Mr. Buckley was hired to perform the exact lined survey of the properties that should be <br /> included in the lease, and his plan is what is being presented here. <br /> Mr. Collins stated for the record that he supports the program, and the Boys and Girls Club. <br /> This has nothing to do with this presentation. He just doesn't want to put the Town through a <br /> legal dilemma; if hypothetically this project moves from Plan Review to Planning, etc., and is <br /> not approved properly through Town Meeting or through the General Board than its going to <br /> be flogged. <br /> Mr. Bonvie said he is not a lawyer, but at Town Meeting the Select Board entered into a lease <br /> with the Boys and Girls Club. Mr. Collins said that is not the issue. Mr. Bonvie believes it is <br /> relevant of the dotted line plan. The plan is now better defined in the lease that he is holding <br /> in his hand which in his stance is the whole aspect of this issue. Is the "dotted" line plan giving <br /> the rights to the Select Board to enter into the negotiations and discussions to sign the lease? <br /> That lease now shows the correct boundaries which he believes the Select Board has a right <br /> to do. <br /> Mr. Collins stated he noticed a significant difference between the two plans. Mr. Bonvie said <br /> the lease states 1.25 acres. The Select Board can enter into a lease and that lease is 1.25 <br /> acres and refers to the correct plan. Mr. Collins will consult with Town Counsel. <br /> Mr. Bonvie asked if he could interact with Town Counsel. Mr. Collins said; "no". <br /> Mr. Morris asked if this presentation should be tabled. Mr. Collins said he doesn't suggest it <br /> be tabled, he just want this to be reviewed by legal, and he is not certain this is legal in its <br /> current form. If legal tells him that this is all set, he will be all set. <br /> Mr. Collins mentioned to Mr. Bonvie to submit the facts to him or an agent that is representing <br /> and if he or she has any questions relative to any follow up, he will authorize Town Counsel <br /> to be in contact with whoever that may be. <br /> 2 <br />
