She is not recalling
item number 4 being tagged as a waiver. Lastly, EV Charging Stations are new, therefore she
does not recall number 5.
Mr. Tobin would like to seek clarity on past practices for item number 2, lot size and shape
criteria, in instances where the code is silent.
Regarding item number 4, Mr. Rusell commented his request for berm is to remain consistent
with everyone on Evergreen Circle who has Cape Cod berm. Every lot on town property, like
the pickleball courts and the dog park has this material. As an applicant, that is confusing,
because he wants to be consistent with neighbors, and it's a cost burden to request that of him
in an industrial park.
Mr. Pesce noted many of those buildings were approved by the ZBA.
The Board was reminded this is a vote on use, a Special Permit for a recreational facility. This
could be awarded approval and be sent to the ZBA by the Building Commissioner. These
waivers will not deviate from the process.
Mr. Hansen inquired about the egress for fire safety and Mr. Russell noted all doors are
consistent with requirements, they are Fire Emergency Exit only, an alarm sounds when
pushed, and no handles on the outside.
Ms. Waygan asked the Applicant the probability of a Landscape Plan being complete before
the next meeting. Mr. Russell asked if a plan could be presented during the construction phase
as he is currently working with the Cape Cod Commission, and it must be approved by them.
Ms. Waygan replied that the Special Permit would be issued with conditions, with the
understanding the Applicant is working on this plan in the meantime. Ultimately, the Building
Commissioner won't sign off on the project unless the Landscaping Plan is approved. Mr.
Russell would like the condition to work through it during the construction phase to make
appropriate design details.
Mr. Pesce noted the applicant would like to move on to the next step. Mr. Russell will require 6
months, as two weeks is not likely.
Ms. Waygan will also condition that construction hours will be 7:OOAM-8:OOPM, 7:OOAM-
4:30PM Saturdays, and nothing on Sundays, barring an emergency. She will also condition
monthly offload reports.
Mr. Russell stated his hours of operation will be 7:OOAM-10:OOPM, as stated in all documents.
He inquired if the base pallet in the shed is a condition. He will seek an entertainment license
as necessary, and any amplified music or outdoor entertainment will require Select Board
3
